Posts: 91 Aug 7 12 6:38 PM	I'd like to know the separation status of a Veteran who I'm not related to. I called my County Clerk but was told a DD214 is not a public record. Is there any source for this Veteran's DD214 without any authorization?

I personally am glad that they are not for public records, not that I have anything to hide, but I see no reason for anyone to have access to them. I realize that not all people are honest about their history of service, but that is on them.

Posts: 8218 Aug 7 12 7:38 PM	Intruder, You still have to be the Veteran, next of kin or an authorized representative. Also: Certain basic information needed to locate military service records, includes: the veteran's complete name as used in service; service number; Social Security Number (if applicable); branch of service; dates of service; date and place of birth. For records affected by the 1973 Fire, additional information, such as place of discharge; last assigned unit; and place of entry into service may be useful.

Edit 2: Even the type of discharge can be accessed by the media. Today's NY Times citing "a source familiar with Page's military history" reported that the killer of the Sikhs in Wisconsin received an other than honorable discharge from the Army. It does seem that way. And SSN seems exempt too. We both drew our info from the exact same site. Without the Veteran or Next-of-Kin's authorization: Without the consent of the veteran or next-of-kin, the NPRC can only release limited information from non-archival Official Military Personnel Files (OMPF) to the general public. Click here for a list of information available under the provisions of the Freedom of Information Act. Obviously their definition of 'limited' is different from mine. Good catch Intruder!

Posts: 1043 Aug 7 12 8:58 PM	The first records center link the I sent appears to draw a line between information on service members discharged before 1951 (publicaly available) and those discharged after 1950 (not available). I have no idea what the rules are. I am still waiting for St Louis to send me my DD 214 based on their records that I requested 4 months ago. Also as I noted in a postscript to my prior post that was sent after your last post, the Media can always get the type of discharge from an unnamed source within 24 hours.

Posts: 2272 Aug 7 12 9:16 PM	Some states used to offer free reg.at local C.Of Courts . However I did'nt take advantage of that in my home state .Very Glad I didn't due to SS # included even though in my time we had srevice #'s . What other have said about being next of kin to deceased for copy or if you are in control of others affairs .I think you get the picture by now.

This exemption protects the privacy interests of individuals by allowing an agency to withhold intimate personal data kept in government files. Only individuals have privacy interests. Corporations and other legal persons have no privacy rights under the sixth exemption. The exemption requires agencies to strike a balance between an individual's privacy interest and the public's right to know. However, since only a clearly unwarranted invasion of privacy is a basis for withholding, there is a perceptible tilt in favor of disclosure in the exemption. Nevertheless, the sixth exemption makes it harder to obtain information about another individual without the consent of that individual. The Privacy Act of 1974 also regulates the disclosure of personal information about an individual. The FOIA and the Privacy Act overlap in part, but there is no inconsistency. An individual seeking records about himself or herself should cite both laws when making a request. This ensures that the maximum amount of dissoluble information will be released. Records that can be denied to an individual under the Privacy Act are not necessarily exempt under the FOIA. The first post of this thread brings up an intersting question, albeit one that is troubling, at least in my opinion. Census records are not released until ~72 years after they were recorded. I think there is a distinct difference from a family member searching info for claim or genealogy purposes and a non-relative seeking info for reasons unknown. JMO
