Posts: 64 Aug 6 12 10:47 AM	Tags : None I filed for p&t,it was denied and lowered from 100% s/c down to 80%.....i then filed another claim for reconsideration with new med evedence. The va sent me a letter saying they are going deffer my 80% and keep me on 100% untill they look at my new evedence and make a determination , my question is: will i have to pay back the difference from 100%to 80% if they deny my claim for reconsideration? the difference from 100 to 80% is $1,500 per month, and as of now its been 12 months that would be around &18,000 i would have to pay back!!!! Posts: 2259 Aug 6 12 12:19 PM	No, you will not have to pay anything back. Even if VA made a rating mistake you wouldn't have to pay it back. Don't sweat it... you are good to go. But have a VSO assist you in keeping your 100% rating.

Posts: 64 Aug 10 12 10:57 AM	VET2112................Thanks for your reply,yes my vso has filed another claim for my 100% p&t immediatly after receivig denial for p&t....and dropping me down to 80%...he filed it as a reconsideration for p&t along with more med evedence, and one doctor wrote a letter which said i was permantly disabled and could not work anymore....i did not ask for IU but do or think its possible the VA could give me IU if they again deny my claim for reconsideration for p&t....in other words my decision letter may state that they deny me p&t but grant me IU.... is this possible ??i was 100% s/c then my first denial for p&t was denied and shot down to 80% i am currently deffered 80% and kept on 100% untill they make a decision on this present claim for reconsideration.
