Posts: 554 Jun 25 12 9:29 AM	Tags : None I was awarded compensation today according to ebenefits and the AB8 on there confuses me a little. It shows an effective date of December 1, 2011 yet my initial claim was August 2010 and that is what the closed claim history shows also. August 2010. The supervisor that called a couple of weeks ago also said that the effective date would still be August 2010. Is there a chance that the date on the AB8 should just be disregarded and when I receive the notice in the mail it may reflect the August 2010 date? I claimed in August 2010, they denied me July of 2011, I requested a reconsideration based on new and material evidence in July 2011 and have now been awarded what should have been in the first place if it wasn't for a C&P Examiner with an agenda. Posts: 2642 Jun 25 12 3:30 PM	Your Aug 2010 file date is just that. Any backpay will be paid from the effective date. You stated that you were denied in July 2011 and asked for reconsideration. The file date was held due to this but the effecitve date could well be July 2011 or later. It is all about the medical evidence. If you supplied more current evidence after the denial the effective date is likley to be the date the VA got that evidence. Hope for the best but be prepared for anything.

I actually chickened out on the request for reconsideration and filed a NOD to preserve the 2010 date prior to the one year deadline. However on the 18th of this month I received a phone call from a Appeals Supervisor at 8:30am, and he said that he called to recommend that I drop my NOD since there was so much evidence and he was going to take this straight up to a ratings officer and that we could put this thing to bed much earlier than waiting on a DRO Review and Hearing. I told him that I didn't think I should do that because I would loose my original date of filing and loose out on a great amount of back pay if awarded. He assured me that August 2010 would remain as the effective date and that I would have a decision well before my 1 year deadline lapsed and if I was not happy with the decision then I could file the NOD at that time and still be good with my 1 year NOD deadline which is July 22, 2012. Well he held true to his word on taking it upstairs to a ratings officer for the day after that phone call my claim moved from claim received and no longer listed under appeals to Preparation for Notification. Now this morning there was the AB8. I do agree with what you are saying though.....anything can happen and I can only Hope and Pray that December 1, 2011 is because of the cola and not an actual effective date because there is not one single document, decision, etc.... that coincides date wise with that date at all. Brace for the worse....Hope and Pray for the best is all I can do. Main thing is I am completely covered with my medications now and there are no longer any copays. The accumulated co-pays so far can be trashed. I am very thankful for that... But money is cool too!

I am suspious of the phone call offering you an effective date but im a crusty old fart that has been burned by promises in the past. But your mind is right. It is a sad statment that we must be thankful for medication and medical coverage, but thats where we are.

Posts: 554 Jun 26 12 2:41 PM	pechg was correct byrddog....That effective date of dec 1,2011 was the COLA. I received the package today and they are paying all the way back to when I first claimed which is Aug 2010.... I appreciate that guy being honest with me....
