Posts: 14 Jun 22 12 10:54 PM	So I got a letter today saying that I would be removed from TDRL to PDRL. My initial TDRL rating was 50% and the PDRL rating is 30%. I had 21 YOS so my retirement is 52.5% anyway. I just got my VA rating at 70% for this condition. So given this should I even care about the TDRL to PDRL? Tomcat98

Posts: 4378 Jun 24 12 12:12 AM	For right now, No, not really. CRDP states that you cannot receive more Retired pay than years of service. I have spoken with DFAS and they explained that when CRDP is fully phased in that Retirees with a PEB Rating will be able to collect whichever is higher, LOS or PEB%. I am not confident that is true, but who knows it might happen. In your situation the only thing that you might be concerned with is getting the 50% to 70%, not 30%. I don't think you can request a Formal PEB so other than asking that they consider your VA rating of 70%, there isn't much to worry about. You know the PEB are supposed to be using the VASRD? So in reality your PEB% and VA% should be the same for the same condition. When I submitted my VA ratings with my first TDRL exam the Navy bumped my % from 40% to 70% and TDRL. 2 months later I got a payment for $440.00 out of nowhere. That is when I contacted DFAS and asked WTF?

Posts: 14 Jun 24 12 8:24 AM	I just want to be done with the DoD. There is no way I want to go back on AD and after 21 yrs I have done my time. I guess I could helped my case with them if I had brought treatment records from the last 6 months, but I really don't trust them. They have Jr people doing the evals. What a joke. Tomcat98

Posts: 14 Jun 26 12 1:31 AM	I assume he meant that 30% is irrelevant for you. It's just a matter of 52.5% or 70%. You have to figure the difference in retirement pay between the two, 17.5%. If you are happy with 52.5% and concurrent receipt take the PDRL and be done with DoD. If you would rather fight for the 70% DoD rating because you are afraid your VA rating might be downgraded in the future then fight for it. Just my two cents...
