One of the problems with most members here answering your question, they are doing your PEB backwards from how they used to.

It used to be that a service member would go through the MEB, then PEB process and if found unfit, given a rating which they could accept or decline and ask for a Formal PEB Board. Then, when you were within 180 days of separation you would file your VA claim. Being medically separated the VA should have assigned a case counselor. The VA would then request a copy of your medical and personnel file, order any C&P exams they wanted done, and process your claim up to the rating stage. Only after they had a DD214 would they actually rate the claim and complete it.

What I can tell you is that the PEB Board I went to, started in January 2008, had an answer for TDRL and a 40% rating in May, which I accepted, then filed my VA claim.

With these new pilot programs were the VA rates members before they go to a PEB Board, many of us just do not know how that works. But there still is a lot of similarities and process which are the same.

PEB is not going to assign you a rating for ALL of your medical conditions that will be considered your disability %. If they find you unfit they will assign the rating for the condition(s) that are unfitting and that would be your retirement rating.
THEY are supposed to rate all medical conditions in your record, but you will only receive the retirement % based on the UNFIT conditions.

If you had a right knee replacement at 30%, left knee arthritis at 10%. That would a bilateral condition (paired extremities) and they would combine to a 40% rating. If the knees were the condition that was found unfitting, that would be your TDRL/PDRL rating
If you also had depression the PEB is supposed to rate that, so say they did 10%.If you have a shoulder problem maybe another 10%
Lower back or neck problems, say 20%.

The other ratings besides the knees would not be used in your final %. Only the conditions that caused them to come to a FIT/UNFIT finding.

The old way was then you would go to the VA, file your claim and they would process your claim but would not get any ratings until you were separated.

With the new process, I would think you could argue that the unfitting conditions should be rated by the PEB at the same % as the VA. If the PEB comes back with a different % for the unfit conditions, then you can request a Formal PEB Board and do it in person. With the emphasis being placed on the service PEB Boards, I think they are trying to follow the directive that their ratings should be what the VA would award.

You guys are a lot better off today than just 3 years ago. No VA rating until you were out, then we had to argue with the PEB during each TDRL exam period and when they gave a final rating %, we did not have the ability to request a Formal Board.
