Posts: 393 Feb 22 12 9:17 PM	A New Hampshire man stumbled upon the terrifying sight of a burglary in process in his home, and took decisive action with a firearm, but now he could face years in jail for foiling the robbery. Foxnews.com has the details of the incident which already has 2nd Amendment advocates up in arms: “Dennis Fleming, 61, of Farmington, was arrested for reckless conduct after the Saturday incident at his 19th century farmhouse. The single grandfather had returned home to find that his home had been burglarized and spotted Joseph Hebert, 27, climbing out of a window at a neighbor’s home. Fleming said he yelled “Freeze!” before firing his gun into the ground, then held Hebert at gunpoint until police arrived.” Sounds like a good outcome to most, doesn’t it? Apparently not to New Hampshire police. Despite the fact that no one was injured in the incident– and the fact that the New Hampshire legislature is considering passage of a version of the “castle doctrine”– two arrests were made at the scene. Fleming has a logical explanation for his actions, as he told Foxnews.com that ”I didn’t think I could handle this guy physically, so I fired into the ground. He stopped. He knew I was serious. I was angry … and I was worried that this guy was going to come after me.” For foiling the robbery of his home, and defending himself from possibly imminent harm if the burglar was armed, Fleming faces a similar prison sentence to the person who he claims was invading his home. While state authorities consider whether Fleming acted within New Hampshire statutes for the protection of life and property, Fleming remains very worried about the possible outcome. “I have 14 grandchildren, I don’t want to be a felon and go to jail,” he told Fox. “I’m kind of wound up about it.” Fleming’s seven rifles and his .38 caliber handgun have already been seized by police. Some New Hampshire locals are already letting it be known that charges against Fleming would be a total affront to the right to bear arms and basic common sense. Penny Dean, a spokeswoman for the Gun Owners of New Hampshire, has claimed her organization is “absolutely outraged.” The Blaze will follow this story and report new developments. Posts: 11385 Feb 23 12 10:53 AM	I see a few fatal errors in Fleming reaction to the situation. Local law trumps. He was not in defense of his life or property. He was acting as a vigilante. Fleming had no direct knowledge to connect the guy coming out the window to any crime. He assumed the guy coming out the window was a burglar, fired his weapon inside city limits. Fleming was not acting in "self-defense", nor was he protecting his own property. Fleming was lucky the man coming out the window was not the cable guy or the property owner's handyman. Posts: 78 Feb 23 12 5:40 PM	I support gun ownership, but Witch hit the issue spot on. The was no imminent threat so the discharge of the firearm is what screwed him. Had he pulled a Dirty Harry with a 'do ya feel lucky. Punk?' and just held him he would be pretty much clear (provided he was licensed to carry, etc, etc). Best option would be to ask for a jury trial and hope you get some sympathy.

Posts: 2610 Apr 1 12 10:25 AM	I guess im just a nutcase and need to move to Montana with the other percieved nutjobs. But I am of the opinion more citizens should pack a gun. And in cases like this fellow he should be rewarded. The police either can not or will not protect the public against criminal activity. The judicial system has became a frickin joke. These are not the days when Marshall Dillon could protect Dodge City from anything. Along the Mexico border there should be a 50 mile free fire zone if the gov't does not want to legalize some of the drugs. The demand in this country will be met in covert way or in your face gun battle. As a society if we deem trafficing is a feloney then these people must be dealt with. Mexican or American we must make the price so high they have to think about it before commiting these crimes. As it is now the border has more holes than my drawers and a slap on the wrist to these people making millions . Now consider gangs, they control large areas and produce fear in the common citizen. There are areas that just can't be lived in by people who abide by the law. Given time and going unchecked this scum will control the country.

Posts: 4024 Apr 2 12 7:29 AM	To add to what WD stated, the NH Legislature is considering changing the law. Currently he is not protected by the "Castle Doctrine". As pointed out, protection of someone else's "Castle" is not justified by current statues and most likely will not be included in any legislation. The definitions of deadly force and the elements of the offense of reckless conduct in NH are what prompted the arrest. Mexico, Dodge City, and gangs have nothing to do with this. He saw no weapon. Discharged a firearm, which my have been a miss rather that firing into the ground. The detained individual presented no real threat to the shooter. Most likely this will be reviewed by the Grand Jury to decide if charges are appropriate. Perhaps they will rely on the case from Pasadena, Texas, but the Granite State isn't Texas. While most people use more convention means to exit a house, not all do so. It isn't a crime to climb out a window. The reckless conduct may be nothing more than discharging a firearm within city limits or some such thing. While sentries in the military may fire a warning shot, most law enforcement agencies, if not all, prohibit warning shots. Cav1Sgt

I recall this one old grandpa who shot someone dead outside the house and said it was in self defense. He didn't even get charged . I think I read that Texas has like a 95% gun ownership. Don't mess with Texas
