I am at the point where I am going to drive to Waco so I can speak to someone that is working on this claim. I was just told rating decision made but claim could take another 18 months. Feel like just telling them to just forget about this Nehmer claim.

That is what I was thinking when they said another 18 months. I get so many different stories I don't know what to believe. They are making me feel crazy. I contacted NSO in Waco for help. Daman, you think it is just a case of someone giving incorrect iformation on it being 18 more months?

@Daman.....sorry if my comment made you upset. That is just the timeline that was given to me. I have never dealt with the va so I am just lost at this point. I have been told rating decision complete in december, then told it was at the raters last week, then told it is development today. That is why I broke down today and called called someone to help me.

Upset me??? NO way.
I no longer have it, but the Nehmer training manual gave a specific time line for claims decided. I believe they HAD to have a deposit made within 21 days.
IF you claim was done and they are telling you another 18 months, then that is a violation of the training manual.
That is why I say somebody is giving somebody BS.
I do not have a phone number for WACO. Have you tried doing an IRIS on the computer?
Do you have E-benefits? What does that tell you of the claim if you do?

Daman...i tried Iris in November with no response. I have no access to e benefits either. The last thing on the file was rating decision completed 12/14/11 by St. Louis. File was then sent back to Waco. On Feb 8th that they sent another letter to a child they suspected to be my fathers ( but the child was adopted by his biological father at age 2). Last week they said it was with raters and today it was in development. I have told them the childs correct name and they mailed him another letter...30 days passed with no response. Can you see why I am lost. The rep today said they could hold the claim because other child did not respond with birth certificate. I am not even sure if it has been rated

OK, now some of it is making sence..The claim WILL go back to development when it is gather more imformation and/or clarification on some issue.
In this case it would go back because of the "child" issue.
The claim "could" very well be rated and ready for a check to be cut, BUT, becuase of the "child" issue everything is being held up.
YOU have NO CONTROL over the "other" person and that "other" person is screwing everything up for you.
Call peggy or send an IRIS to set up an appointment with someone at WACO. or if they would be willing to set up a phone call for you.

Good News!!!!! I have made contact with child in question and he is sending in copy of the papers showing he was adopted by his biological father. This shows that my dad was not his dad. Maybe the claim will move forward now.

Once again, it is up to the child to get YOUR claim finished.
Trusting him to do it in a timely fashion just may cause you more heart aches.
It is NOT a VA issue, so to speak.
Did he acknowledge that the VA sent him a request and he had 30 days to do it? If so, what was his excuse? What makes you think he will do it for you now???

He had no idea they sent him a and itnything. I actually got him to scan the original and email it to me. I am faxing it to Waco as well as mailing it.......using certified mail of course. He was really nice about all of it.

This information about the child will cause it to back to development. I don't think there is a need to worry. Loose ends need to be tied up, but 18 months? No way. She was probably talking about all the Nehmers being done in 18 months, I don't know. She is a "call center". Try to find the number to the actual RO in Waco and ask for a Veteran's Advocate.

@Donella.....i cannot seem to get number to the Waco RO. I did contact a VSO that works right beside the Waco office. I am trying to find anything that I can, hopefully his documents will speed it up now. Thank you all for all the help!!!!

You have proven the point again that we are each our own best representative with the VA, investigating and digging for required information, researching complex VBA regs and making sure our evidence meets their standards and level of proof.

The whole system is in massive overload bending in the wind of large numbers of vets, old and new, filing. The NSOs/VSOs are overloaded and have little time to give indepth howto advice or to work on cases. VARO ROs have little time to dedicate to individual cases hunting for the required by reg. evidence.

we all would love to hear the final outcome of your complex long process.

He "could" be for the time he was with your father, legal issue and many many facets to it.
However once adopted then ALL ties (legal) are severed and your father is not responsible for anything, thus the child is not a dependant either.

Quick update....as of 3/18/12 claim with raters for rating correction. What exactly does that meam, is it because they now have the proof that the other child had been adopted?

I doubt it. RATE has nothing to do with dependants (other than for payment).
Could be anything that someone picked up upon review of the final claim.
Could be in your favor..Could also be against you. Such as it was rated at 30 and upon review it should have been 60, or the other way...
