So I have a very good question about what is a pre existing condition. First I was last discharged in 2006 with a toatal od 12 years service. I imediatly filed a claim for compensation everything but my right knee and left wrist was approved. both those they claim were pre existing conditions. feb2011 I applied for reevaluation on my back and neck for they had gotten considerably worse and again on my knee and wrist. this last nov they increased my ratings on my neck and back but yet again claimed my knee and wrist as pre existing. Now my knee possibly could have been due to a motorcycle accident I was in over a year before entering the service, yet never bothered me untill basic training, all thru basic ait and all first duty assignment it would bother me to the point of hardle able to walk. went on sick call numerous times. no treatment other than a basic exam was ever done than the required prescription of motrin and profile of no boots running and such. after 3 1/2 years of this I was hardshipped off active duty. few months later knee was hurting so went to a dr they xrayed and folled that with an mri finding that I had bone fragment floating around iin my knee that was tearing the joint up. had orthoscopic surgery. wich for most part has cured it not 100% but was able gd enough to complete another 9 1/2 years in the guard with several fed and state deployments including to Iraq with out it effecting my performance. The real kicker here tho is my left wrist, I was stationed in Korea and fell backwards off the top of a hemmit landing on my left hand, was sent to yongsan airbase for xrays where determined I had a hairline fracture spent 8 weeks in # casts. left hand and wrist has never been same funtional yes but loss og grip constant popping and so forth. My question is especially with my wrist how can that be considered a pre existing condition? thanks for any help and I appologize for the length.
