Posts: 535 Feb 3 12 12:09 AM	Back in the Day when I was just Rated at 30% I thought I could claim my Child since I was Paying Support, a Service Officer said i could NOT claim her,REMEMBER, I didnt know much about the system and I took NO for an answer,my question is can I get Dependent pay since she lives with me now and eligible for Ch 35 and in college, since I am P & T When my Daughter start getting her money shorthly,I THINK i saw somewhere I CAN'T get Dependent pay ANYMORE although it has not started yet,also when they give my Daughter her Money will they go back to when I file for Unemployablity and give her Back pay?her School counselor said they would go back when I file for unemployablity or my Daughter can Opt to have it start January 1st as her start date to start receiving benefits. INPUT PLEASE

Talk to a VSO if you don't get any answers here. Posts: 11390 Feb 3 12 8:20 AM	When your daughter is receiving Chapter 35 DEA benefits, you can no longer receive the additional compensation money for her as your dependent. Prior to her reaching 18 or attending school, if you were over 30% and providing her support, you are entitled to the dependent compensation amount. You should be back paid from the effective date of your 30% until she turned 18 or finished school (while not getting Chapter 35 DEA). Member-at-large: Disturbed Veterans of America.

Posts: 10265 Feb 3 12 12:59 PM	A Dependent does not have to live with the Veteran. Nor does the Veteran need to provide for the Dependent's support. For the Veteran to receive the additional Dependent Benefits. As long as the Veteran has a Compensation Rating of 30% or above. VA recognizes the veteran's biological child, adopted child, and stepchild. However, the child must be unmarried and: 1) under the age of 18, or 2) at least 18 but under 23 and pursuing an approved course of education, or 3) permanently incapable of self support before reaching the age of 18. Posts: 649 Feb 3 12 2:07 PM	It's unfortunate that the VSO provided you with inaccurate info. My son did not live with me and I payed support. When I first got my rating it did not include him. I called Peggy, she told me the form I needed to complete and gave me a fax number to fax it too. And low and behold, 6 weeks later I received back pay and was payed the additional compensation until he turned 18. I only recently found out that I can still get it because he is a full time student. Called Peggy got the form and she gave me the fax number. Mind you I'm not expecting the same rapid completion, but can hope. I hope you can get back pay for all the time that she wasn't on your claim. Best of luck to you and thank you for your service. J

Posts: 535 Feb 3 12 5:04 PM	I got in contact with the 800# today it was my appointment callback,and they told me they will go back to APRIL 9 2008 I will be paid from that date forward,of course thats when i became Permentant Total but once i get that Back pay thats it,so hopefully I will get $7-$8,000 when i do get it. they've had the paper since September, be glad when its all over,then I can focus on getting my Teeth done
