Posts: 258 Dec 16 11 2:11 AM	So, I just recieved a ruling from the BVA & my appeal was remanded for a C&P exam. My question is, will the results of the C&P go back to Washington or sent back to the local level for a DRO to make the decision? If it goes back to Washington do I have to re-wait for all the newer claims/appeals to bet worked? and lastly, will all previous evidence for my disability be considered or will the decision be based on the C&P exam results only? The reason I ask is because the civilian docs disagree with the military docs in my medical documentation & if the C&P doc dosn't look at the private doctors notes which was mentioned & provided in the BVA notes all things will not be considered. I just recieved the BVA decision today so I'm hoping for a quick C&P exam, I hope it dosn't take 3 months to get scedualed. I have been fighting this for 6 years now... from the initial decision to the BVA remand now. I will be taking the civilian medical documentation to my C&P for sure just in case. Thanks all

Posts: 6043 Dec 16 11 7:49 PM	The BVA will specifiy exactly WHAT THEY WANT in their remand. The C&P exam will be set up to provide whatever specific information that the BVA wants clarified. It depends on how the remand is worded on deciding who makes the next decision. It could be the regional office, IF that's what the BVA said to do. If the BVA retained jurisdiction, then they will make the decision. Posts: 840 Mar 2 12 1:56 AM	I agree with The Old Medic and just add that the BVA will/has put a suspense date on that remanded exam. VAROs typically do not want heat from the BVA so you should get a timely exam. On rare occasion a VARO will drop the ball, but then the VBA tears a new hole in their you-know-what.

Posts: 20 May 21 12 4:02 AM	I just had a BVA remanded claim kicked back to RO for new C&P which was completed in March of this year. The RO has since forwarded my appeal to AMC where it stands now. According to e-benefits, "Your case has been received at BVA, and BVA has mailed your decision to you (and your representative, if any) and will be returning your claims file to the Appeals Management Center or, if represented by an attorney, the Regional Office. How long would this (AMC) process normally take as a guesstamet?
