I don't know if my claim is "simple" or not.
I think we all feel that our claim is simple because we know ourselves and our claim inside and out. I guess we just have to realize that these VA folks have to look at each claim carefully.
I've had my decision since July 6 2011, but they proposed an incompetency issue. My VA doc laughed at this proposal and quickly wrote a letter to reverse it (July 22). Peggy said it's been forwarded to the "Non-rating" team here in Oakland RO as of October 13, but E-benefits still shows development phase two months later.
It's been 5 months for them to look at a medical doc's opinion for a non-rating issue. I feel it's simple because it's a yes/no type of thing and the popular opinion here on yuku is that if there's a medical opinion against, they don't really fight for incomp. My inital rating took almost 13 months and now they've delayed it by another 5+ mos.
If they find me as incompetent, I'll get thrown into the fiduciary/payee grinder.... maybe an additional year or so!
All this for a decision that gets to skip the "Rating" phase. The wait is tedious. Especially because I'm waiting to hear if I'm "incompetent" or not!
Question is: What is the Non-Rating team? What other claims do they deal with.... or do they see all presumptives too?
