I had a consult with a 3rd party medical doctor yesterday in response to my request for an increase in my disability rating. He asked me questions from the schedule of ratings like how many times I am affected by my disability.
I never had an opportunity to meet and or even speak with anyone when I originally submitted my request for benefits some eleven years ago, so I'm really wondering now how they ever came to the low figure that they did. (If I were only affected 2x in a six month period, I never would have been discharged as my disability would be nearly undetectable!)
Is this perhaps an error on behalf of the VA? I asked a couple of times over the years when I saw my specialist if I might be rated correctly, but they never helped me. I only recently became aware that I didn't think I was being rated correctly.
I know the VA will normally only back pay to when you filed for an increase, unless there is a case of clear error on the VA's behalf. It seems like the VA sends everybody to a consult with at least somebody now before assigning a rating, is this not true? I thought it was a little odd that I got a rating decision back in like four weeks without so much as to even having to write a letter or meet with anyone.
