Posts: 7 Oct 29 11 1:47 PM	Tags : ptsd, appeal, varo, psychiatrist, anxiety disorder, memories, winston-salem, shrink Waited 40 years and finally had C&P Exam said I had an anxiety disorder. Got 10% I appealed by letter, 11 mos ago. My hearing is next month. Got down-sized at my job this past summer; was told I had a history of being difficult to manage. I worked from home most of my recent career. I don't take drugs and never met with a shrink for fear of my employer finding out. My memories of rocket attacks won't go away, especially when fireworks go off, or I hear gunfire on a newscast from the Middle East or I hear a helicopter approaching. Any tips? My bride of 40+ years may accompany me to the hearing in Winston-Salem. my 1st post here. Gary 25th ID in country: June 68-69 Bronze Star

Posts: 25193 Oct 29 11 1:59 PM	Gary, Look at the FAQs at the top of this PTSD Forum....that will give you everything you need to know. Then, go to your appointment and be open, honest, don't hold back, and tell it like it is...you'll do fine! Fillean meal ar an meallaire.

There are tons of "actual appeal experience" on the web site. http://vets.yuku.com/foru...ension-Exams-and-Appeals So, you already got SC'd for MH at 10 % - you filed a NOD which started your appeal and now you have a hearing scheduled. If you are appealing the evaluation percentage of 10% there will need to be medical evidence submitted or of record, that supports the criteria for a higher percentage. The rating decision you received will tell you exactly what the medical evidence must show to warrant an evaluation at a higher percentage. JMHO

Thanks for posting, CarlieC, ! Yes, I read it over many times. The word processor they used copied and pasted some same paragraph text several times, repeated. Not professional. I worked on computers most of my life. I know (too much?) how data can get shared, read by wrong people. Therefore, I never met with any shrink or filed an insurance claim for one, for fear of my employers finding out. At my hearing: My wife will be a witness, after I request permission to step outside of the room. Posts: 252 Nov 13 11 7:19 PM	Gary, Not to discourage you but if you haven't received any treatment for mental health issues, you may have a difficult time showing that you are having difficulties above the 10% level. Now other than that fact, going for treatment would be beneficial not just for claim purposes, but for your well being! It is time to stop worrying about whether others might find out & accept that you have problems that you can't handle yourself. Something that might help to illustrate your difficulties would be if you could get a letter from your former employer including the info that they felt you were difficult to manage. If you can't get something official from the company, perhaps a co-worker who was aware of that point of view, could write a letter. Even if you can get either, you should send a letter yourself, letting them know that you were downsized & what you were told. Good luck & God bless!

The same employer has decided to keep me very part time, on a month to month basis, If I bring up any issue from the past, especially regarding mental stuff it could really affect continued employment, I feel. I suspect his fear of getting sued for putting anything non-positive. in writing. UPDATE: I had the 11/28 hearing with a service officer. Was told I appealed using wrong words, so I filled out another appeal form and handed it across the table to the officer. I said PTSD instead of anxiety disorder on my appeal. And , now that over a year has passed I also have to appeal that as well. Total frustration and hoping for another exam to get percentage raised. Wife also spoke "on the record" after I left hearing room. Gary Edited 2 times by Dec 2 11 8:29 PM.
