I've FINALLY got a positive result after 7 yrs of fighting with the V.A. for an increase rating for my Hep C. My claim was initiated in 2004 right after retirement and it's been in appeal, remand, appeal, remand, appeal cycle all this time. FINALLY got notification from AMC that they ruled. They granted me an increase to 60%, making my total rating 100%. But they made the effective date of increase Aug 4th, 2011, so I won't get any retro pay for those years in appeal. I understand that it's a lot of $$ ( 96 months at approx $1000/mo) so I can see the VA's ''reasoning'' as to why they made the effective date like they did. I totally believe that the effective date of claim should be the original date of claim, or at the very least, 2007 since that is when my video hearing was held and the judge noted that ''...obviously the condition has gotten worse..." I'm at a loss as to what to do now. Don't get me wrong.... I'm happy with the increase rating. I just feel the effective date of claim is wrong.
