My husband and I are still waiting for our claims but we were wondering about the dependents vs. no dependents.
He has a son (15) and daughter (18) from a previous marriage. Ex is also on active duty and the kids remained under her in DEERS. At first we claimed the daughter and she claimed the son on taxes. Two years ago he came to live with us and we claimed him on taxes and she claimed the daughter. We kept him enrolled under her DEERS as she lived in Korea and said we could only switch him if we all were in the same building at the same time(that was never going to happen).
The daughter is in her first year of college and we are supporting her completely. The son still lives with us but is under his mother's DEERS, as she still won't change it to us and we didnt' fight it because my husband retired and it just seemed easier.
Does the VA award compensation with dependents based on DEERS enrollment? or how to they determine that? If so, can we file a claim and prove that we are providing for his college age daughter and have full custody of his son? We have all the court documents to prove we have custody.
Also, I will be also receiving a claim, because I am now his caregiver and provider can I claim him as a dependent? Do they award two veterans for dependents or just one? Thanks for all your help!!
