Posts: 269 Apr 21 11 11:46 AM	Tags : None I'v been reading in few other places that the cut off date is Aug 2011 for filing new claims for IHD. I don't know how true this is. . Please read lates information:http://www.topix.c om/life/veterans/2011/04/chang es-in-agent-orange-benefits-im pact-veterans-more-delays . I would think this is to slow down the claims and get them awarded to said Veteran and his wife or family.

Posts: 2852 Apr 21 11 11:53 AM	jjmate, I think someone is just spreading rumors. Their is only one thing on the AO list that has a true cutoff date and that was within one year after being exposed. IHD is not it. Enjoy Life!!

Posts: 824 Apr 21 11 11:58 AM	As I understand, claims filed between Aug 2010 and Aug 2011, the effective date will be Aug 2010 for retro pay. I've not read anything concerning claims filed arter Aug 2011 but assume the claim date will be the date of filing.

Posts: 3985 Apr 21 11 12:49 PM	The article is correct...HOWEVER It is the rule for the new presumptives and deals ONLY with the retro date of claim. You have until Aug of 2011 to file and get reto date back to Aug 2010. If you file after Aug 2011 your date of claim will be when you submit it, not before, as is the case with normal VA claims.

Posts: 851 Apr 22 11 8:37 AM	The people that I feel the most for are those who still do not know about the new AO presumptive. It is hard to imagine in todays media coverage that there could be anyone who does not know. But they are out there. I run into 3 or 4 a month. I know the new presumptive cuts retro pay for anyone who files after August 31, 2011. But IMO, if some VET is just finding out about the presumptive, he/she should bet at least one year back retro pay. Especially if they are like most of us who have sufferred for 20 years or more. I only knew about about it because a fellow VET emailed an article on it. Also with the defective lead that was put in 2007 for my AICD, I saw an add on TV by a lawyer just before the deadline closed to get in on the class action suit. Just as the VA claim, that suit is taking it's time. I did receive that my final papers had been filed with the settlement court and I sould receive a check sometime in August. I am lucky again in that even though I have the same defective wire, it has not fractured or split since 2007. Therefore my settlement will be small around $2500 before lawyers fees and then I might have enough to get a cup of coffee. Have ablessed day Doug

Posts: 3386 Apr 23 11 10:08 AM	not everyone knew of agent orange presumptives... i was one of them.... i would not of known about it even after i got the agent orange flyer in the mail as i did not know what it is or was. the only good thing was i went for the ao screening and heart disease was inferred at that time 2006.. hearing loss was why why i went they said i was not deaf enough, and no respose to the dam noises in both ears that does not stop.. doctor walked away and said your done...i read somewhere in the forum if the va does not research an inferred claim they will notify you.. that did not happen either. no research and no respose only a denial for hearing loss and tinnitus... oh well. my cardio dr goes back to 1997 when problems with heart started am going for ep study to try and stop the arrthymia..dont know about the aicd as final resort.. hope yoour lead dont fail happy holiday

I had (have) 2 brother in laws, one died of a presumptive and the other just had surgery for a presumptive, neither one had any idea they could make a claim, so if you figure 3 guys in one family in Vietnam all at the same time and 2/3 rds had no idea they could make a claim. I bet that there are still hundreds of thousands out there that not only don't know about the new presumptives but never heard of the old presumptives. I never knew about any of this until I read an article in AARP a year ago. I think most of the guys here in VBN have had to rely on the VA for their medical care and thus heard about all this. Posts: 549 Apr 23 11 11:08 PM	I saw an article in my "American Legion Magazine" in last Sept. Issue..I was getting ready to call my VSO and got a letter in the mail from the VA Nehner center in Auburn Washington. A couple of days later a lady from there called me and asked if I wanted to have a C&P exam scheduled...Told her yes, and got another call a couple of days later with a C&P date about a week later, with a ECCO test scheduled at another facility a couple of weeks later. I had everything else in my personal files so it all got sent in within a month after I first heard of Nehmer.. Went in with a claim date of 11-23-10...I'm now in decision, but that could be a long time there... Good luck to all... Chief B

Posts: 4561 Apr 24 11 8:30 AM	Ther is only a cut off date for claims having Nehmer protection. This was a liberalized law so those that filed from Aug 31, 2010 to Aug 31, 2011 will have an effective date of Aug 31, 2010. After August 31, 2011. Whatever date you file will be your effective date.

I went 38 years not knowing and 2 SC was in records from Qui Nhon, Vietnam. Did not have a physical when I got out of service. Just wanted to put all the memories behind and get on with a normal life. But now I am 80% SC , 60% pay rate and more to come. Kind of a bummer. Enjoy Life!!
