Posts: 8 Mar 22 11 4:53 PM	Can anyone tell me if VA Form 21-0960A-1 (I.H.D.) questionaire is only used for fast track? I filed for I.H.D. presumptive back in March 2010 and since Jan 15 2011 have been told my claim was in the decision stage even though e-benefits listed it as closed. The claim is retro back to 1998 (Nehmer). Recently I was sent a letter along with a VA Form 4142 asking if I had any additional evidence. I didn't but made the mistake of sending them the 4142 for the hospital records that they already had. Now I get a letter from them saying they are requesting the records from the hospital--the same records I already sent them and my claim is going from awaiting decision to development. Should I have the Hospital send in a negative reply as to the records? Should I send them a VA Form 21-960A-1 even though they have the records which would back up that form? Tks very much.

Posts: 12935 Mar 22 11 5:48 PM 10,000 plus post...	They send those letters all the time, the reality is that just want to see your current staus with tests within the last year. That form was good but if you have the info they want just copy and send it again. Don't ever tell the VA to get your records, get them your self and send them in. Posts: 8 Mar 22 11 7:53 PM	Thanks Lou. I think I'm going to have the hospital make a negative request for the records stating that the veteran has previously sent them. I also am not going to send in the questionaire as the info (documents that would support it) are already in my claim file. Also don't want to overload them with duplicate documents. I believe that the questionaire came out after I filed anyway and I believe it is for the fast track folks which my claim was not originally filed under. As for the e-benefits site can't understand why it says my claim is closed as of Jan 15 2011 and every time I called them after that they say no it's not closed it's in decision stage. It really is frustrating to the veteran seeing it being closed when it is not making e-benefits more of a headache than a help. I'm just hoping that now that they say they took it out of "ready for decision" stage and put it into "development" stage because of the 4142 they don't take forever to get it back to "ready for decision".

Posts: 4561 Mar 23 11 7:56 AM	Probably rating review closed in Jan. The actual claim is probably still in decision. I would not overload them with records you have already sent, I would send in the IHD questionaire. It is not just for fast track, the form was just developed and became part of the process, I think in May. A recently filled out questionaire would be new and material evidence.
