Posts: 15 Mar 9 11 11:38 PM	Tags : rating, exam, help, pay Hello, everyone! I need assistance with a claim originally opened for my honorable medically discharge from 1993. I put in my claim package prior to leaving the NAVY for a cyst removal surgery on wrist. Also, I had a numerous of other service connected problems on my claim. Thigh contusion hit by boat dent quad hyper extended knee nail fungus yellow removal of big toe nails ingrown toenails index finger fracture wrist surgery & scar lower back problems cant recall all due to a fire my personal copy of the findings and medical record was destroyed. My initial exam and claim provided 10 -15 service connected disabilities with the ratings returned of 0% to all of them. Young and dumb I overlooked the significance of an appeal to increase rating and I am to blame for not following up. Now, I was called for an appointment 18 years later for re examinations for all my service connections. What should I expect? I truly lost thousands for not knowing to appeal the initial process. Is there any way to get back pay for not appealing the process from 1993? I think thousands of soldiers are misguided for what they are do, as well as I was.. Thanks for your guidance and help..

Posts: 15 Mar 9 11 11:58 PM	Do I need to take in civilian medical records to assist in the exam? Also, how can someone have so may service connection medical problems 10-15 with no Compensation? I truly dont understand the system.

Posts: 1094 Mar 10 11 12:03 AM	the key is , continuity of treatment on your 0% awards. if you have medical records that show treatment for service connected problems,that is good evidence for an increase. a lot of vets fail to get treatment for years and try to get increased,but continuity of treatment shoots them in the foot.

Im not a big expert but I have figured out a few things the big dogs will want to know. 1) Was it VA, NPRS, or personal records you lost? 2) If You have a VA claim for all those origanal claims will be noted in your Cfile. Have you had any care for them since then? 3) As long as there is serrvice connection and treatment of some sort, claiming from your last play time with VA is very do able. 4) Even if none of the above exist you can still reopen your claim asking for the higher evel from then. It would be a lot tougher than 3 but Ive read hearings of vets that have and won. 5) Be patient in these circumstances. Very little is going to happen very fast more than likely because it will take a while to piece together. 6) If you have any of your own records. Get copy and turn in also any thing that you feel really points out whats going on high light (BESIDE) that section so they will know you feel its very pertinant. DONT hightlight over the top cause it makes copies more difficult. With all this said good luck you already know you got a hill to climb so try not to get to stressed. OOPS you answer Q1. Posts: 623 Mar 10 11 12:22 AM	You can make it easier for VA by getting the address and phone # of the records departments of places youve had treatment. Verify these before giving them to VA to make sure they havent changed. If any of the places charge for records I think VA policy is to no pay so you will want to get those on your own if you want a solid claim. Theres really great info here of how to build a very good claim that VA can proccess easier than many that come in just cause of how you organized it for them. Posts: 15 Mar 10 11 12:25 AM	Before leaving active service I worked for the Va disability counselor for the Marines and I was told to get my claim package out immediately from discharge. Also, to make copies of medical records for personal. I went to exam and receive findings late 1993 for all my service connections. My personal copy of medical records and findings were destroyed but I received a copy of findings several years ago. So, I no they have everything on file. That's when a VA rep looked at my copy and said I should be able to get back pay for findings. I did but thought there was requirement to wait until my lump pay for the med board exhausted. Received 20 % for injuries from the NAVY but 0 % for VA COMPENSATION.... To date I'm still confused of the process but I know it will be a long process but hopefully my kids will benefit from the outcome. It sadden me to think of what I gave to the Navy and what was returned to me.. but can't cry over spilled milk.

Im really going in the blind from 17 years ago...can't recall all what they gave me service connection for. But recall it being 3 pages of connections....

Posts: 623 Mar 10 11 12:37 AM	So listen to your VSO get advise from here and have fun. LOL You actually appear to have a good claim in my oppinion. You already know its not gonna get done very fast. Check out fanaticbooks stuff on making a good claim if your VSO is missing any of the valuable things you find here you both can learn and help each other thus be able to help other vets better later

I got a letter today from The Department of Veterans AFFAIR to check in with Compensation and Pension Staff 3/15/11. I know for a fact recalling 10 -15 service connections from 1993 with explanations why service connections and why 0 %. It was quite lengthy in pages. The last exam I had with VA was in 1993.. but I recall going to out patient VA several times since then.

VSO = VET SERVICE ORG= vet rep, vet service officer= DVA, VFW, AMERCAN LEGION, VETNAM VETS OF AMERICA, GULF WAR VETS OF AMERICA, on and on. look i cant give you any more discriptive info I have dementa. Im trying to help your self with info the real smart and knowing vets will need to give you specific info if there is any. I've been out of NAVY since 1993 and cant recall all the abbreviations. I was a Gulf war Veteran. I worked with a rep ( a purple heart veteran who educated veterans on process of claim) >>VERY WISE AND KNOWLEDGEABLE MAN THAT CARED HOW VETERANS WERE TREATED AND MISGUIDED. He was an inspiration for my family and I... Several months ago before sending increase package in, I received a call from his daughter that he passed away.. I was shocked and saddened because of my notification weeks after and unable to go to his funeral... but she forgave me because I didn't know. Now I work with DAV....they sent a request for re exam. Now I call him and he's not available. I guess my luck is'nt good on the VA process.

Posts: 3228 Mar 10 11 1:28 AM	If you received a Severance payment at discharge that amount will be withheld before you receive compensation from VA. How much was your severance? If you want to know what your current SErvice Connected conditions are call 1-800-827-1000 and ask them to list them. If you are 0% for a condition; medical records from years ago don't matter; only your current level of disability does. If you are not 0% for a condition then those medical records will be needed.

I asked all those things cause some one else wouldve needed more info. I like talkin to other vets and want to help some so i try to help vets to explain some of the stuff the big dogs will need to know
