I have done a some searching on the forum and can't seem to find the info I need. I am presently discussing UI with my Voc Rehab councilor, and the 1 class a semester that I am able to handle, is well becoming too much for me to handle. I am presently 80% SC due to multiple joint injuries (ankle, bilateral knees, Thoracic spine, Cervical Spine, and Jaw) as well as migraine HA all resulting from a "training accident" that occurred while on active duty.
My issue is, presently my family owns it's own business, and had created a position there for me to work, menial desk work, light bookkeeping type stuff, in order to have an income; otherwise there would be no job in the world I could hold down. They call it a "full time position" but with all the appointments and sick time, I'm really only there between 20-25 hrs a week if I'm lucky. It was mainly to get me out of the house. When discussing UI with the Voc Rehab councilor she told me that the info passed on to her was that if awarded UI I would have to terminate any and all employment immediately. I told her that was not what I had read in the CFR online, but her response was that it really wasn't her area and that I would have to make the decision myself. So big surprise, information that wasn't entirely truthful, then no help to determine the real answers.
I'm just mainly looking for help on where to go next. It's the holidays do I haven't been to my SO yet...but I was hoping maybe someone in here knew of anything online. Everything I find just has the generic statement, "Examples of this marginal status include employment in the protected environment of a family business or sheltered workshop" and "on a “facts found” basis." I really have no idea what this means. Does it mean they have to come and check out what I do at my job?, and/or how much I'll be making to determine if I'll qualify? ..who knows....
The only reason I am exploring this option, is even though at present I technically have employment thru my family, lets just say...we all know how families are...so the business could evaporate at any time, a month from now...or 6 months...or 10 years...I just want to have my ducks in a row so when I need to take care of my family, I can.
