Posts: 534 Nov 27 10 11:25 PM	Tags : None Good Day everyone... If you get to 100% (schedular) on five health issues is it automatically Permanent and Total? I am a little confused as to how and what the P&T actually means in the world of the VA. I ask this question because in our state to get many VA benefits (tax breaks/freebies) you not only have to be 100% but have to be P&T as well. Can you be 100% schedular and not P&T? Posts: 1271 Nov 28 10 12:21 AM	Chancedog, In my case, I was 100% for almost 3-1/2 yrs. before I was awarded P&T. In my case, I was undergoing treatment for cancer. Once my treatment was completed the first year, I was called in for C&P. Before they could rate me, the cancer returned and was kept on 100% rating. Eventually the treatment concluded, called for C&P again, this time they found that the residuals from the radiation and chemo had done damage to my lungs so I was awarded P&T. Once awarded P&T the award letter will state something like "eligibility to chapter 35 benefits is hereby established"due to the condition not presumed to get any better. (paraphrased). If you do get such an award the VA upon request will give you an award letter so you can apply to your state for benefits. cacti

Posts: 4990 Nov 28 10 12:22 AM	Yes you can get 100% schedular and not be P&T. To get to P&T the va must determine that your condition will not change. Usually this is becaue of a serious disease or very serious injury. You can request P/T any time you want to but it may requre you to undergo another C&P exam. It might help to talk to your doctor and see if he/she feels your condition will not change. I don't know of any case were 100% P/T was based on more than one conditon. But that doesn't mean it doesn't happen. good luck

If improvement is likely and/or future exams are scheduled, then generally P&T is not granted. Most of the claims I have seen rated P&T are based on multiple disabilities. Cav

In the last 24 years which includes time I was a service officer I never saw anyone get P/T for anything except the one issue. Usually that issue was the one rated 100% or TDIU. Right now I am P/T for asthma/COPD at 100%. Prior to that I was P/T for my back rated at 60% with TDIU. I also have multiple ratings of 0% 10% 20% and 30%.. none of which were ever considered to be P/T. I guess if a veteran has a lot of 10-20-30% issues and they are serious medical issues that combine to 100% anything is possible.

Posts: 534 Nov 28 10 1:26 PM	71, The following is break down of what I have: 60%--Stomach 40%--Back 30%--PTSD 10%--Clavicle 10%--Right Knee 10%--Left Knee 10%--Right Foot 10%--Left Foot --------- 90% in the fuzzy school of math. I also am waiting for the decision on Sleep Apnea with CPAP use which is 50% and will put me at 100% schedular. As you can see I am pretty much a mess and one day short of going on SSDI because I can no longer work. I force myself to work each day because I feel that I am way too young to retire, but my body does not agree. Day by day for me. I am just trying to plan ahead for the future to see if and when and how I will be assigned P&T. Nothing I have is 100% total, but many things to put me at 100%. I would like to hear what your experience as a VSO with a case like mine...Any thoughts you might have would be appreciate. The P&T would help my family financially regarding taxes and other benefits since I will not be working and income so limited. My doctor has been very good over the years with providing the VA with letters and documentation to support my claim. I just want to be sure I send in the right info. Thanks again!
