Posts: 26 Aug 26 07 6:09 PM	Tags : None To anyone with insight, I'm currently rated 30 percent for Parkinson's. I just had a C&P done on the 3rd of July, 2007. I had asked for a rate increase since summer of 2003. The doctor that did the C&P exam let me know in his report that he said my PD condition was severe. I am max'ed out on my meds and my VA neuro said that the only thing left is to have surgery (deep brian stimulation). While I was at my local VA benefits office to update my dependants, I ask if there was any movement on my claim. The VA rep check the computer and told me that it was in the Reno office as of 1 August. My question is what is the average time for a decision for increase or stay the same or reduction in percentages? I'm in a little bit of a crisis because of my condition, I'm having a hard time hiding my tremors and I'm having problems walking. I don't know about the rest of the stuff, but I noticed at the end of you question you mentioned probably having to resign from law enforcement due to your condition. Before you consider resigning, check and make sure you aren't entitled to a disability retirement from your agency (local, state or federal). I know that when working for the federal government, you can receive a disability retirement after just 18mos of service if they can't meet just one of your needs etc. Spree USAF Vet '00-'07

Posts: 7750 Aug 26 07 8:32 PM	How long does it take? No one really knows the answer to that question. It takes what it takes and is dependant on many things. Additionally, the claims process isn't like tracking a FedEx package where each step brings the package closer to it's goal. Your claim may go back and forth between development and the raters multiple times as new information leads to more requests from other agencies for verification. It also might go back and forth to the VAMC for a C&P several times depending on how well the examiner documented the requirements of the decision maker. Knowing where it is and where it's been doesn't provide a guarantee of "what's left". Some simple claims might be adjudicated in 6 weeks but more complex claims might take 18 mos or more. How busy is the VARO, How many issues are you claiming? How much evidence supporting the claim did you submit and how much evidence does the VA have to try and obtain from other agencies? All of these things might affect your claim. They might also make decisions on some simple issues and defer the more complex ones. You can see that there are many steps in the claims process so even if you're familiar with the process you can't judge with any degree of accuracy how much longer your claim will be at any certain point.

Posts: 17467 Aug 26 07 8:43 PM	Please keep in mind that 30 percent is the minimum evaluation for Parkinson's Disease. Normally PD is broken down and evaluated based on the actual functional impairment of each body part or system such as 10 percent for left leg, 10 percent for right leg, etc. When the variously affected parts or systems do not combine to more than 30 percent, a single 30 percent is assigned. In order to receive more than the current 30 percent VA will have to stop the single 30 percent and assign separate evaluations as described above. I only mention this because depending on what your symptoms were at the time the 30 percent was assigned, it is possible that your condition has increased in severity without there being a corresponding increase in the evaluation, or at least an increase that is comparable to the increase in symptoms. Does this make sense? In other words it is possible that your actual functional impairment based on the Rating Schedule was less than 30 percent when the 30 percent was assigned. I just wanted to help you understand how this condition is evaluated so you will understand what is happening when you are re-evaluated. Cruiser

Posts: 806 Aug 26 07 11:13 PM	My experience has been that normally, notice I said normally, this means barring any additional development that may be needed you will hear something within 60 days of the C/P exam. At least that is the way it is in my area. Hope the same for you. Good luck with the increase.

Posts: 26 Aug 27 07 6:41 PM	Mahalo for the replies, Cruiser, I was initially rated 30 percent for tremors to the left side of my body (hand, arm and leg). Now my whole body trembles and the meds don't seem to be working as well as before. I recieved some good news today from the DAV. I'll just quote portions of the letter. The DAV has just reviewed the most recent VA decision concerning your claim for benefits. A combined evaluation of 60 percent has been assigned as a result of the following action(s). Service connection for major depressive disorder including sleep impairmentid granted with an evaluation of 30 percent effective June 19, 2006. Service connection for chronic fibromyalgia is granted with an evaluation of 20 percent effective June 19, 2006. An evaluation of 20 percent is reassigned from December 2, 2006. Since the letter didn't mention anything about Parkinsons. I assume that the VA is still working on it. Knowing I'm at 60 percent disabled. I can rest easyer now and patiently wait for a decision about my PD. From a 91 Gulf War Vet, again mahalo for the replies. Semper Fi!! ch46crewchief phrogs the work horse of the corps

I've been following how many the number drop (150 each week) so being at the bottom, i figure somewhere around 2 years from now I'll finally get a rating. prolly sooner than that but just my fun example. Posts: 4438 Aug 28 07 11:04 AM	In my opinion, I dont think you can use the VA Monday Morning Report to get an estimated time line on how long it will take the VA to process and or adjudicate your claim. I submitted a request for an increase and it took about fifteen (15) months to adjudicate my claim for one (1) single disability. I went back and looked at the VA Monday Morning Report and the Regional office had 3800 claims pending at that time. The VA had to request my C-file from the Regional office that did my initial claim, claim development, request C&P exam etc. When I submitted a request for a NOD, for the same claim I had to get a MRI and another C&P exam and a decision was made in three (3) months. Nine months later I submitted a request for Unemployable IU and it took approximately Six (6) months to adjudicate my claim and it was Farmed out to a different Regional office. And the Regional office that Farmed the claim out had about 3700 claims pending. I would half to agree with SteamJockey explanation as stated above. To many factors may be involved with different issues etc. robert

Posts: 1 Nov 9 11 7:16 AM	We've been waiting for my husband's re-eval for 27 months now. He has also been waiting for a CUE (Clear and Unmistakable Error) for 12 months! They listed his INITIAL injury at 30% injury for P.T.S.D. (should have been CHRONIC P.T.S.D.) and didn't include his Superventricual Tacycardia so now he's paying for his meds. for his heart condition ... they said the CUE would take 7-10 days (RIGHT!!!!) it's been 12 months. They owe us over $12,000 for back medications he's been paying for for 10 years now so just don't get your hopes up with the VA -- they screw the Veteran whenever they can. Sad but true!!! He did get his C-PAP machine and the VA did pay for his sleep study and this only took 2 years. He's had sleep Apnea for 40+ years and finally has the C-PAP machine and it makes a world of difference! Edited 1 time by wowlynn Nov 9 11 7:21 AM.
