You have to look at the Requirements for the Different 100% Ratings. Here is a 100% Physical Rating 7202 Tongue, Loss of Whole or Part With inability to communicate by speech. Here is a 100% Mental Rating Total occupational and social impairment, due to such symptoms as: gross impairment in thought processes or communication; persistent delusions or hallucinations; grossly inappropriate behavior; persistent danger of hurting self or others; intermittent inability to perform activities of daily living (including maintenance of minimal personal hygiene); disorientation to time or place; memory loss for names of close relatives, own occupation, or own name The Veteran with the 100% Physical Rating would be able to work...even though the Veteran could not speak. On the other hand, the Veteran with the 100% Mental Rating, According to the Criteria, would be Greatly Impaired. Pick ANY ONE of the Criteria...for the 100% Mental Rating...and it would be difficult for the Veteran to Function, let alone More Than One. Now...the Question. How Many Veterans that are Rated 100% Mental...actually meet the Criteria for the 100% Mental Rating? Survivir

So I Answered "You"(cleascher). Just because someone can NOT hold down a job...does NOT mean that they are eligible for TDIU or even SSDI. There are requirements that MUST be met...with TDIU or SSDI...and they are NOT the same requiremnts. A Veteran could have BOTH Legs Amputated and be rated 100% by the VA. But that does NOT mean that the Veteran will be qualified for SSDI. A Veteran could be run down by a truck and not be able to work. That Veteran could receive SSDI...but NOT 100% VA...because the accident did NOT happen when the Veteran was IN the Military. Getting SSDI does NOT entitle the Veteran to VA Compensation. Any more than a 100% VA Rating entitles a Veteran to SSDI. Survivir

ChicagoBob, I am also from Chicago. I get the impression that you were not in combat. Some people say its like having one's central nervous system fried because one has adrenalin pumping through their veins 24 hours a day for...a year. Or more. It changes the entire nature of ones thought-processes. And dream cycle. If one is lucky enough to find sleep. Everyday I wake up and want to kill myself. I don't know why. I don't even mean to be suicidal. Its almost like my mind puts the thought at the center fo my conscience as a way of saying, here is the answer, if you don't want to suffer any longer. Its like having a large stress ball that consumes you between your eyes, all the time. Yes, I can still pick up a hammer and do manual labor but that is not the point. Another example, right now I want to physically assault you. This is not a threat but a dead honest submission to you about what is going through my mind. You don't have respect and my violent combat mind says punch this guy. Again I do not mean to be rude but that is how the mind works after spending long periods of time engaged in constant battle far away from home. Be a little bit more considerate. I think, what you think, that if you have a brain then you ought to do all us a favor and use your brain.... not what you sit on for logic. I think it is time for some to take account of their own situation, I worked for 40 years with my situation...... stumbling and failing as I went.. I barley survived without beating guys like you to dirt. Now..... I see what I was doing..... and I have less control now that before. I pity small minds. Combat PTSD is not a thing one can turn off.. Everyday is a challenge, gut I go forth.. Good luck

Posts: 807 Sep 30 10 8:44 PM	The standard for 100% mental should be looked at. if Snuffy is profoundly affected witha s/c mental imparment, but can build birdhouses -for example- and seel them on ebay, even if he needs help, then why penalize him. If Snuffy can do anything at his pace that makes him feel productive and contributing, why not. And don't come back and tell me what the regs say, I'm saying they may have been written before so much was known about mental wounds and how much self esteem needs to be redeveloped, which some kind of productive endevour for a few bucks would help achieve. I'm not saying dont question if the vet is working full time, but some small home enterprise, maybe with social worker supervision without worrying about getting reevaluated would help a lot of isolated 100% mental folks.

Ok, I get it... but you asked the question.... don't shoot the messenger they are only passing on the requirements...... If you have a suggestion on how or what the regulation should say tell the va, cause telling us isn't going to get any changes done.... If you feel like hurting someone then get to the hospital.. you need help.... The fact remains, if you think you can work then you should not be asking for or rated for IU.

My local VA rep said I should fill out a 21-8940 (application for increased comp based on unemployability) - Is this the right step to try and get 100% Any help would be a "Victory" for me! The criteria for 100% Schedular for Mental Health disabilities is: Total occupational and social impairment. The symptoms listed are suggestions, not criteria. Cleascher You have been on every board asking questions all over the chart. If you have a question related to your conditions please ask. Just to ask a question for the heck of it takes time from others that need help as well. If you get a decision you do not agree with as you stated in the other boards file a NOD with the VA. Hypothetical questions all over the place helps no one Don`t get me wrong I enjoy helping other vets as much as I can. I would never deny you help.

Survivir I am one that doesn't fall into the symptoms of 100% but am rated 100% due severe social and occupational limitations. The VA Best Practices Manual for PTSD states that it is more appropriate to give a veteran with no possibility of employmenty 100% rather than 70% plus I/U. The decision specifically cited that I did not display the criteria, however, because of the C & P examiners statements, supporting statements from my Psychiatrist, two vet center counselors and a psychologist at my inability to maintain employment, 100% is granted. (that is paraphrased). Believe me, I would give back their few thousand a month if I could work. When I was employed I made much more than the ssdi and VA benefits. Vietnam '67 - '68 11B

They both said as long as I am not on Unemployability then it will have no effect on my rating. Granted I'm not looking to hold down a full time job as a corporate manager, i just get the feeling I could find sometthing that I can do with a schedule that will allow me to work on my good days and stay home on my bad days. I showed my psych and the VA regional office this line everyone in here quotes "Total occupational and social impairment, due to such symptoms as" and they both said that if they were to take away your rating/income because you found a menial job making birdhouses or such, then it would also mean that would take it away if they saw you socializing with friends on a sunday afternoon. My advice is talk to your psych and regional office. Don't try to hide what you are doing. Just ask beforehand. 100% P&T means you are 100% unable to function as you did before your injury/illness. That true whether it is physical or mental. Why someone thinks the VA would be kosher with a 100% physical rated person getting a $30,000/year job, but not a person with a 100% mental rating doing the same is a mystery to me. The VA has that other rating called unemployability. It's called unemployability because you are unemployable. If your rating isn't IU, then the VA does not consider you unemployable. That's straight from the VA regional office--and she didn't say it flippantly without checking on it. I bugged her enough till she pored over the regs, called Atlanta, had a conference call with her supervisor, etc. Total occupational and social disability means you'll never be able to do things like you could before. You'll never be able to hold down a traditional 40-hour week job with stability. It doesn't mean you can't change oil in automobiles twice a week or build birdhouses and sell them on ebay or to local hardware stores. It doesn't mean you can't cut someone's lawn. Why some folks think the VA would be ok with a 100% physical disability cutting someone's lawn, but be against a 100% mental person cut that lawn is beyond me. Who is more unable to do physical labor like cutting grass--a physically disabled person or a mentally disabled person? Bottom line-talk to your psych and regional office, tell them your plans, see what they say. Rant over.

Posts: 993 Feb 12 11 6:54 PM	Unfortunately there still is a "stigma" against people with "invisible disabilities", especially mental health. If Tammy Duckworth can overcome her missing legs and still work, she is a "hero". On the other hand, if a person with a mental disability (100 percent) overcomes their disabilities and works, then he is a fraud, because he was never mentally disabled in the first place. This is just wrong, and discriminatory against people with mental disabilities. Its been going on for centuries. The Va rating criteria are supposed to approximate the average decrease in earning capacity. That does not mean that if you are 100 percent you cant work, and Tammy Duckworth and Max Cleland are well known examples. I would like to see someone with a 100 percent mental disability overcome all the odds against them, and be able to work, especially something hi profile like as a Senator. The rating criteria means an AVERAGE person cant work in those circumstances, it does not mean you are AVERAGE!

The regs are not fair at all. Fight for every little bit of your life back. Don't let them win.

Posts: 1971 Feb 14 11 11:51 AM	who said "life is fair'? the rules are the rules try and get Congress to change the laws but supposedly to get a 100% rating for mental health it means that you are unemployable and not capable of working I don't see any exceptions in the ratings criteria for people to build bird houses or for bi polar people to work on their good days it plainly states the veteran is unemployable do what you want but when they match your IRS records to your VA records and send you the bill for over payments don't be shocked or when they move to reduce you from 100% to either 70% or 50% depending on the new C&P exam you are going to get
