Greetings to all vets. The good thing about this website is you learn new things everyday from the experts and I thank them perpetually for sharing their knowledge. I read from one of the topics that the VA can not just outright reduce the rating if there is n no "SUSTAINED IMPROVEMENT" on the awarded SC disability. In my case, my orthopedic disabilities specifically my SC right knee was reduced from 20% to 10% after only a few months since the award. A few months later, during a regular check up on my knee, the same VA doctor who did my C and P and who requested of the reduction of the rating wrote on the progress notes that my knee has gotten worse and recommended me for surgery and TKR( I am only in my mid 40's). To make the story short, I underwent a medical procedure called athrotomy and menisectomy and subsequently was granted another 10% for instability. It has only been less than a year since the reduction. Can I request for reinstatement of the initial rating of 20%? Does it say anywhere in the CFR that the VA can not legally reduce rating if there is no sustained improvement. I believe Mr. Cruiser has pointed this out in one of the topics.
