Posts: 508 Aug 27 10 4:33 PM	depends...if you are oif/oef vet, yes, the Caregivers and Veterans Omnibus Health Services Act. ought to be called OIF/OEF Caregivers and Veterans Omnibus Health Services Act. If you are pre-9/11 no, no benefits as caregiver, and aid and attendance is nothing compared to what this bill provides to caregivers of OIF/.OEF vets crs summary, section 101 5/5/2010--Public Law. (This measure has not been amended since it was passed by the House on April 21, 2010. The summary of that version is repeated here.) Caregivers and Veterans Omnibus Health Services Act of 2010 - Title I - Caregiver Support Section 101 - Directs the Secretary of Veterans Affairs (VA) to establish a program of comprehensive assistance for family caregivers of any veteran who: (1) is undergoing medical discharge from the Armed Forces; (2) has a serious injury incurred or aggravated in the line of duty on or after September 11, 2001; and (3) is in need of personal care services. Includes among such assistance personal care services instruction and training, ongoing technical support, counseling, and lodging and subsistence while accompanying the veteran for VA medical care. Allows additional assistance for the primary personal care provider, including mental health services, respite care, and a monthly stipend comparable to that provided to commercial caregivers in that geographic area. Requires the Secretary, with respect to such assistance, to: (1) designate one family member as the primary personal care provider, subject to approval by the veteran concerned; (2) monitor the well-being of each veteran receiving personal care services, and take corrective actions as necessary; (3) carry out outreach to inform eligible veterans and family members of the program; (4) establish a program of general caregiver support services for caregivers of veterans enrolled in the VA health care system, and provide outreach about that program; (5) develop and submit to the congressional veterans committees a plan for the implementation of the comprehensive assistance program; (6) report annually to such committees on plan implementation; and (7) submit a one-time report on the feasibility and advisability of expanding the program to cover veterans who have a serious injury incurred or aggravated before September 11, 2001. Authorizes appropriations. roflmao... forgot, it DID authorize a 'one -time' report on feasibility of expanding to pre 9//11 ... lets see... yea, that will happen... the report that is. Just like the post 9/11 gi bill though, everyone else is dumped. doesn't matter that some VN vets wives ( or family ) have been caring for them for decades without any benefit.. but that's acceptable because we were not as well trained or as well motivated, so our caregivers can just suck it up and deal with it.

The wording in Section 101 does not give what rating or injuries that are required to qualify. With your job title, I want to say thanks for keeping the roads safe for many. Posts: 3220 Oct 28 10 9:30 PM	markw1968, since you feel the current generation of veterans are receiving special treatment and that there should be NO difference in benefits for veterans regardless of when they served maybe you can answer this question. Before 1980 you only need ONE day of Active Duty to qualify for Comprehensive Health Care from the VA. After 1980, you MUST serve a minimum of 24 MONTHS of Active Duty to qualify for Comprehensive Health Care from the VA. So I guess veterans serving before 1980 (to include Vietnam Vets) don't have it "better" then those after 1980? Laws change and there is always a cutoff line to how far back to go for budget concerns. This poster only has 20 posts on the Veterans' Benefits Network. Did he really earn those comments you made about the current generation of veterans?

As he said compared to A&A OIF/OEF veterans got a real nice benefit with Caregivers and Veterans Omnibus Health Services Act. Is it right that they get compensation benefits over and above other vets? NO it is not right.. Was he blaming OIF/OEF Veterans no.. he was just stating facts.....This was just another way for congress to pit vet against vet. I get A&A and it is nothing compared to this new benefit, and doesn't come anywhere close to covering care taker expenses. My spouse left her job to take care of needs, and at our age, it is not easy for her. No vet from one era should get better treatment than a vet from another era....

Posts: 3220 Oct 29 10 12:54 AM	To clarify this benefit; It requires the veteran to have been Medically discharged/Retired. If you are a OIF-OEF veteran and separate without a medical board you are NOT eligible for this benefit. If you are a OIF-OEF veteran and separate without a medical board and then are diagnosed with a Presumptive condition which requires your wife to bathe you and take you to the bathroom; you are NOT ELIGIBLE for this benefit. Then the veteran must be "SEVERELY" injured. Then the veteran must require "personal Assistance". This is NOT help doing the dishes or driving a veteran to a med appt. This means the Veteran MUST require assistance going to the bathroom or bathing. IU at 100% with additional disabilities at 60% (which is an alternate requirement for A&A) will NOT make a veteran eligible for this benefit. This Law was written with the most Severely Injured in mind. Do you know anyone that requires their Wife's assistance bathing and going to the bathroom? I DO - and that is an unspeakable burden. Every OIF-OEF veteran is NOT eligible for this benefit. I'll bet there is less than a 1000 veterans who will qualify for this out of the hundreds of thousands OIF-OEF veterans that have served.

There must be a way to protest that I am not saying that they should not get it , but the last time i checked wounds from combat are the same from each war. unless there wounds were inflicted totally different than the rest of ours. This is nothing but a bunch of sorry a** politicians trying to look good.

Posts: 155 Nov 16 10 11:03 PM	In this Bill, I read about the SGLI being extended permantly for people me medically retired after 2005 if the person was totally disabled. Who's definition of totally disabled? The Army Rated me at 80% and the V.A., eventually rated me at 100% The time frame was 2 years before this bill. My question is this, Am I now eligible to apply for the SGLI? Thanks. Gatormsc

Just like happens after every major war, special programs come out to focus on the large amount of veterans coming from that war into the VA system. While it is true that this new program's purpose is to help only post-9/11 vets, it is totally false to say that if you are not post 9/11 that that makes you obsolete and not elibible for the same services. The VA constantly gives out false and misleading information and may even target sites such as this one, where their experts basically fabricate (lie) in order to cut down on budget expenditures and their workload. Consider the absurdity, if it were true that you have to be post-9/11 to be eligible for a caregiver program: You are a Gulf War vet; you lost your left leg and both arms when you were hit by an IED during combat ops in Iraq. But, it happened two weeks before September 11, 2001. Or, you served in Vietnam, your chopper got shot down on approach to a hot LZ, you lost your left eye, got hit in the spine by two rounds from an AK-47 and had been paraplegic in a wheel chair ever since you got shipped back stateside, but stayed, by waiver, in the service and was issued said wheelchair. Then, a year ago you regain mobility, are able to walk after years of rehab. You served 30 years, much of that in combat in Nam and later in Iraq, since your recovery fluctuated, and sometimes you were able to ambulate and do your job as an intel analyst, your new job after being a door-gunner, air assault crew chief. Don't believe the rumors here, no matter who tells them, including so-called VA experts currently on the VA payroll, or members of disabled vet groups. They may be well intended, but they are totally wrong.

Posts: 43 May 12 11 6:09 AM	whitenight, If you will look at the opening post of this thread, the gentleman was asking if his wife could get compensation for caring for him. While it is true that the majority of these caregiver benefits have been and will be available for pre-911 veterans, the COMPENSATION FOR THE CAREGIVER of those veterans IS NOT AVAILABLE. This bill affords the post-911 eligible veteran's caregiver for compensation. I posted in another thread the link to the explanation. The caregiver (after approval and appointed by the VA) will be compensated for up to 40 hours a week, depending upon how disabled the veteran is. That is to say, how many Activities of Daily Living they need help with. The compensation will be based on Bureau of Labor statistics for such services (caregiving) and also based on region in which veteran lives. Then, I believe there is a factor of 4.35 - if I am recalling correctly - that they will multiply that by to reach a total for compensation. That is the MAJOR difference. The VA DOES provided good benefits to severely disabled service connected, 100% P&T veterans. We know, because our Dad is the recipient of these benefits now. He is - and has been for many years - at the 'nursing home/LTC level' - but we now have him at home. The VA provides 14 hours of home health aid services a week, which, if you have ever been in the position of caring for a totally dependent, disabled person, is a God send. However, there is no compensation to the caregiver of the pre-911 veteran. Still, I believe this is a good bill for those eligible and I am glad the VA has realized that it is best for everyone involved to compensate the caregiver. 1) The veteran will do so much better in a home setting. 2) The compensation will help financially and possibly avoid all the hardships those of us without compensation have experienced. 3) It will save the VA an enormous amount of money by compensating an at-home caregiver for the veteran. Otherwise, many of those veterans would have to be cared for in an institutionalized LTC setting, and from experience, we know how much that can cost (In our area, private pay for LTC is around $100K/year). Also, private pay IN HOME health aid care (Personal Service attendant, NOT CNA level) runs about $23/hr.)

I would hope in the future as the VA gets more statistical support for this through accounting and other means they will see that it makes more sense to use this program VA wide for all veterans, rather than just a few. If the statistics and budgeting bear this out, then I think you will see the VA pushing congress to amend this law to include all era's of veterans that would benefit from this type of care. If it saves money on a large scale I do not see how the VA and the Congress could do anything but support widening its coverage to further budgetary savings from long term health care expenses. Just my thoughts, and time will tell.

If after 10+ years of involvment in OIF - OEF there are less than 1000 vets who qualify; why not include VN Vets? Should only add a couple of 1000 Vets to the program and would make treatment of all Vets equal. That is what we all are working for. Right? The only thing harder than being a soldier is loving one. Any Veteran since 9/11 who has loss of any daily living activity, and the new rules, are in receipt of special monthly compensation, have difficulty walking-climbing stairs-transferring-difficulties with memory-problems with organization and organized thoughts-and a few more criteria. That was the big issue with Senator Murray, New Veterans Affairs Committee Chairman with Secretary Shinseki. The VA started with guidelines that would have disqualifed most Veterans who are 100% P&T. So they changed the rules on who qualifies and even added if the VA PCM thinks the Veteran would benefit from the program, I think these changes reflect what the legislators intended to start with. And I do believe that I read something about expanding the program in years to come for all Veterans which I surely hope they do.
