Jack there was a post a while ago, I think it was 71infantry. The post discussed a court decision that stated a second clothing allowance may be granted if a Veteran has more than 1 cause for an annual clothing allowance.

1 Clothing allowance would cover something like a metal hinged brace for a knee that wears and tears on pants. A second clothing may be allowed if the Veteran has a second brace for a different limb, or is using topical skin creams that stain clothing. A Veteran sent in an appeal, the court heard it and made a statement that a second clothing allowance is not unlawful. There is nowhere in the regulations that I have seen that says only 1 clothing allowance is allowed. I have read the handbook, the instruction, and as the court pointed out, there is not anything stating only 1 is allowed.

I was prescribed a second metal hinged brace for my left knee, as I already had one for my right knee. I have a static annual clothing allowance which means I never have to apply again for the first award. I sent in the request for an additional clothing allowance with the award for the first, a copy of the courts decision Sursley V. Peake, 2007-2008, a copy of the Rx for the brace, the brace specifications, and the annual clothing allowance request. The letter I received from the prosthetic department said my claim had been reviewed and will be processed and paid in August 2010.

My point is, don't always accept what the VA tells you when you call. I have been told I was not eligible for multiple benefits that I received later. I do not think it will actually get paid, I think someone will review it and try to stop payment, and then as infantry has done I will send in an appeal. Since the department head is the one who approves the clothing allowance and she approved the second one, I might get paid, but we will see. If I do, I will be sure and keep telling all naysayers that it is not allowed so they will not request one. (Just kidding) We'll see what happens in August.
