I have a pending disability claim for a right ankle injury that occurred June 2009, and I was discharged from AD July 2009. I had my C&P today, which wasn't really an exam, just a bunch of questions. The doc never touched or looked at my ankle.
I had surgery done Jan 15th, 2010, by a private doctor, using my private insurance on my right ankle, 2 screws (ORIF) put in, and secondary ligament reconstruction of the ATF ligament. I know the highest rating I can get is 40% for my ankle, and that's best case scenario. Since I had surgery by a private MD, and before SC has been established; how do I go about the 100% Convalescent rating? I'm still in my post-op cam walker cast, and I'm not full weight bearing. My private doctor said I will be non-weight bearing, and in my cast for at least 6 months.
How do they rate an injury if they never examined the ankle? How do they determine convalescence rating? During the exam the doc said everything was in my C-File, and there's no doubt my ankle is SC'd so there was no need to look at my foot, due the time-frame from discharge and surgery.
