Posts: 152 Apr 7 10 10:39 AM	Tags : None I have been awarded 100% permanent and total disability through the VA administration as of last July. I already receive ChampVa and have my disabled veterans plates (for 2 cars at $10 a plate that last for years and years). I am applying for my loan discharge of my student loans next. My question here is is that I have applied for social security disability too. It is at the 5th level with the doctors evaluating it. I am wondering what the likely hood is that they will award me social security disability? I have enough points to receive it. They also have all my VA paper work and my award letter. Are there a lot of vets like me that have the 100% IU P&T but also receive social security disability? Another question I have is there anything else for us 100% P&T vets that I might be able to receive and don't know of? I also reside in West Virginia and my husband is a disabled combat veteran. Posts: 91 Apr 7 10 11:00 AM	I am just the opposite. I have been on SSD for close to 7 years. The VA has me rated at 30%. I lost my leg above the knee last October and so far still only 30%. It has me wondering what the hell has to happen for me to qualify with the VA as 100% P&T? I served in Operation Desert Storm and was injured while serving. I had a water tank, commonly known as a "Water Buffalo" collapse on my left leg. I have also put in for depression and PTSD. I was told that my amputation only qualifies me as 60% disabled with the VA. You lose your leg and you are 60% disabled? If you ask me... That is a bunch of bull. I am hoping in the next couple of months I get some good news. I just went for a C&P exam on the 6th of April.

Posts: 152 Apr 7 10 11:08 AM	Hutch, sorry to hear about your leg. I think it is ridiculous that SS and the VA can make decisions so different from each other. I am praying to God that my SSD gets approved. I have no idea how long it will take. How hard was it for you to get SSD? I had no issues with the VA. I think a lot of it is about the person that is handling your claim. Everywhere I read says that it is hard to get VA 100% IU permanent and total disability. I was blessed in that I got it in a matter of months. Now I read that it is hard to get SSD but that it is harder to get the VA P&T so I am only hoping that the weight of the VA award to me helps me get the SSD. I also thank you for your service to our country. I use to haul around them darn water buffalo's as I was motor T. Also, how long did it take you to hear about your award from SSD and how did your process go?

I filed Oct 09....still waiting....its in the medical review stage now....SSD examiner said maybe this month I'll here the results....so 6+ months waiting for initial approval or denial....50/50 chance on the first go around....I wish you the best.... Hutch ....sorry about your injury......don't give up the fight with the VA....hopefully the VA will increase you from 30% to 60% for your leg....and award you additional 50% or 70% for your depression.....thanks for your service....then apply for IU... Posts: 152 Apr 7 10 3:10 PM	Gunny, I filed March 2. They said I'd hear something this week or next week. It seems to be going pretty quick. I don't know if that's a good thing or a bad, ugh. I am hoping pretty good since I have a lot, and I mean a lot of documentation. I filed for SSD on 4 different things, and am still in the process on my back. However, the PTSD is the one that will get me the SSD and when I talked to the man at the disability determination center, he said they would have a verdict for me this week. I am keeping my fingers crossed. I think it should be a cut and dry case if the VA awards you 100% P&T. I mean after all if the VA says your unemployable, then you're unemployable. I can't go work and make extra cash being IU so......Gunny, do you have 100% IU P&T?

Posts: 152 Apr 7 10 3:14 PM	Gunny, I'm also looking forward to the SSD because the lady said I'd be back paid to the last time I worked. That was in '06 so that'd be a pretty nice check. If I do get that, I am putting it as a down payment on a house. I'd love for that to happen. fingers crossed!

Posts: 414 Apr 7 10 3:26 PM	Not yet 100 P&T IU....applied for IU in Dec 09....after I was denied Voc Rehab due to "not feasible" unemployable....VRE counselor took me over to VSO to fill out IU paperwork...I was approved ILP Jan 10 by VRE....home assessment complete Jan 10....ILP plan in final stage for a period of 24 months starting Apr 10....I'm just waiting for final decisions from SSDI, VA and VRE....

Posts: 152 Apr 7 10 3:35 PM	Wow, let me tell you I understand your stress in waiting for an answer. My IU went really fast. I got it in 2 months. As far as SSD, it seems to be going pretty fast. I am so anxious to find out about SSD. I just cannot wait for this to be done and approved (again, fingers crossed). I hate waiting. Where are you out of, which state? I really hate this waiting part. I hope it was just like my IU claim. Now that it is done and over with, waiting seems trivial. I am very glad I did it. Moreover, if I get this SS it'll be the best decision I made. Not only will I be set financially for the rest of my life, but my family is taken care of no matter what.

Posts: 152 Apr 7 10 3:50 PM	Thanks, I give God the credit. I have been out of the USMC for 7 years now. I just got my disability rating last summer. I didn't even know about VA disability until last year. I applied and got it right off the bat. I was blessed and lucky. I am in WV by the way. The VA worked well for me and I am hoping to have the same ease with SSD. One would think that a IU claim from the VA would weigh heavy in the SSD department. I am sorry to hear that you've been waiting for so long. It is worth it though. I just got my ChampVA the other day for my family and that's worth its weight in gold.

Posts: 307 Apr 7 10 4:46 PM	Mellisa, I don't quite understand " You will be paid back paid to the last time I worked" I think you have that wrong. Or at least that wasn't how it worked for me. I've been on SSDI since 1999. I had to wait 5 or 6 monts and then I got my first check but it only included the 5 or 6 months I waited . I'm sure people with more smarts than I will chime in. Is your IU 70 , 80 , 90 payable at the 100% rate? Also remember SSDI only awards you for total disability , where the VA standards are different. Posts: 239 Apr 7 10 9:46 PM	Hi Folks, I just went through hell the last two years. I was diagnosed with MDD at the VA. I have suffered a divorce and a layoff shortly following the divorce. I was awarded ssdi and the VA indicates favorably "more likely than not" service related. I have completed two C and P's. One was a psychological interview and the second was a physical. My counselor encourages me to go back to work. I was unemployed for 2 years and it and the divorce wrecked havic on what was a really good life. I was strong middle class, and almost lost everything. I now suffer with upper back and neck pain, my GAF score was horrible. The depression really killed me, I was a A student in school. At the VA I could hardly make out who was talking to me. Memory suffering, concentration suffering, and the awfull "fog" in the brain. Things are getting better other than the body pains, but the financial damage has already been done, major. I now also have trouble with sleep and just getting around. Feels like I have hunch back. I'm approaching middle age and really don't think it's a good idea to go back to work with these problems. Even though I was making 50k and supporting a very large family who has now ditched me. My question is how long is the VA dissability process? My SSDI is only a couple thousand a month and I can't do for my daughter now like I use to. She is 20, but still. The divorce, job loss, and MDD caused me to half to sell my house during one of the worst down turns in history. I have MDD (didn't know what it was or that I had it) going all the way back to my early service days. All I knew is that I got depressed, and had very bad side effects (sleep, and "out of body experience"). Didn't know this was a dissorder until recently. I applied for SSDI and was awarded in jan 09. I applied for VA at the same time in june 08, two c and p's completed. Waiting for a decision. Wondering how long the decision takes? Thank You

Posts: 152 Apr 8 10 8:31 AM	hey ex, The VA disability process varies. Once they get your claim they have 3 months to make a determination. If they do not find favorably for you, then you can appeal it which can take 4 months. Then there can be a cycling of appeals. It all depends when you filed. They also back pay you to the date of when you first filed. My first claim took 3 months exactly, my second claim took 1-2 months and that was for 100%. I had a lot of documentation from when I was on active duty so it wasn't hard for them to make a decision in my favor. That's another thing that matters. Do you have a lot of documentation in your military service files? I make over 3,000 a month on VA disability and stand to get SS soon. It will be another 1,400. That is tax free also, so it takes care of me and my family. I am blessed. Also so many benefits come from being 100% VA disabled. My children and husband are covered under Champva and can go to college for free. Also, all of my student loans are discharged. That is just the tip of the iceberg.

Posts: 152 Apr 8 10 8:48 AM	hey everyone, I literally just got off the phone with the social security administration. I asked them about the back pay. They said, and I quote "You will be back paid to the date they find your disability began to render you unable to work". That would be back in 06. He said they'd back pay be to that date minus a 5 month period. So, just so everyone knows, I will be getting the back pay if I am blessed with SS which he said shouldn't be a big problem because they take the VA's 100% into heavy consideration. He also said that I get paid a monthly fee and an auxiliary pay for each child because I have enough work credits. Keeping fingers crossed that I get it soon!

Posts: 91 Apr 8 10 2:58 PM	Melissa & Gunny... I got denied the first go round on my SSD, hired a lawyer and got approved in a matter of weeks. SCAM!!! Funny how as soon as I hired the lawyer I was approved and he got 20% of my back pay. I too hope that I get awarded at least 60% for my amputation and at least 70% for my depression. All this mess has led to a couple of attempts to end it all. I feel like I have failed my family. I have 3 kids. It's been really tough on them. I went for my C&P exam on Monday. If you are 100% P&T through the VA it should be a breeze to get your SSD. I wish you luck with your new home. You deserve it. Quick question. Can any of you tell me what my rating would be if I am 30% RSD, 60% amputation, and 70% depression? :-)

Posts: 221 Apr 8 10 4:11 PM	Melissa, I believe you will find that for SSDI, benefits can accrue from date of application and up to 12 months retroactive from date of application (minus the 5 month waiting period). Your established onset date will determine how far back your entitlement goes. Established onset date is the determination SSA makes about when your disability began. It may be based on a combination of application date, date employment stopped and date of medically verified disability. However, it will not exceed 12 months prior to your application date. Your tax status for social security disability benefits depends on adjusted gross income. If your husband works, your income could rise to the level that SSDI benefits become taxable. If your income is limited to VA compensation and SSDI benefits, then you probably will not have a tax liability. Being rated TDIU P&T speaks to your level of disability, but that decision is not BINDING on SSA. They are two distinct systems. SSA is obligated to give weight to VA's decision, but SSA will make their decision based on their own rules. Hope that helps. Good luck with your claim. The case worker wrote it up as "more likely than not service related". I really feal bad about things I did for my family that makes me feal like it helped put me where I'm at. Things that were suppost to be good things but bring bad thoughts now. Things like dinners, and movies, etc.. They say this is all normal behavior, but when things suddenly go badly for you, it brings on depression. I never thought i would be considered dissabled, but I certainly hope it comes through now. I need it for myself and my daughter. I never in my wildest dreams thought i would be considered dissabled. Nor did I ever imagine a time when I would be considered non employable. This really sucks. I hope the VA helps with a dissability rating. I have completed 2 c and p's and waiting for paperwork to reach back to the VA. I have lost over 150k in personnel wealth in the last 3 years. Now I'm on a damn dissability. I hope and pray a VA rating will come through. Thanks to anyone who is reading. This has changed my life completely. I always in the past thought hard work and dedication brings prossperity, and if you didn't have it, it was b/c you didn't work hard enough or willing to work hard enough. I have found myself in difficult times even after being prossperous. I think I could do it again, but I'm getting to the age I would not be able to keep it, if I made it there again. So I'm hoping for a VA dissability. If it doesn't come through, I will half to either stay on SSDI or go back and try to do it again.
