Posts: 2141 Mar 12 10 3:04 PM	On Wednesday march 10, The Senate Armed Services Committee’s Subcommittee on Personnel and Readiness held their annual hearing to gain insights from DoD personnel executives and veteran service organizations. While it was no surprise that the VSOs recommended expansion of CRDP, Secretary Stanley, Undersecretary of Defense for Personnel and Readiness, (replaced Dr. Chu) stated in his submitted testimony, support for CRDP expansion: At the same time, in seeking that broader equity and Department-wide impact, we see a win-win opportunity in expanding the concurrent receipt program to include military disability retirees with less than 20 years of service regardless of disability rating. This expansion would cover our most challenged retirees by allowing them to receive retired pay for their years of service performed and VA disability compensation for their future reduced earning capability. And for those Nay-Sayers...and we know...that they know...that we know who they are...and I will NOT mention any of the "1968" names. But, seriously, WHEN I do GET my "280" I will more likely than not...re-invest it into the System by spending it on needed stuff...and not needed stuff, too. So therefore, my "280" would be an On-Going Stimulas that would benefit the Country...EVERY MONTH...and NOT just Once a Year. Survivir

This reeks of Dr Chu's statement ( that I recently found) based on non-disabled 20+ retiree's income , that the 20+ retirees were "doing quite well". This is part of the problem with the 61 argument. So the 'most challenged', say under 4, are going to get a whoppin ..oh what.. 10o bucks? Yes, that is a big help to them. As before, it is making out that the 61's are more entitled to it. ..

It might not seem like a lot to you...but "280" bucks is "280" bucks. It's more about the principle of it. In order to become a Retiree...a Chapter 61 Retiree...one MUST be rated "at least" 30%. When an OVER 20 Retires...they get 2 1/2% per year that they served. That is ALL that I am asking for...because my NOW "280" was based on my 2 1/2% per year. So, just how do you figure we Chapter 61er's are asking for more than what anyone else is entitled? I also got Screwed/Jipped/Shafted...out of Advancement in Rank...and those extra bucks that went alone with it, too. Survivir

Posts: 2141 Mar 13 10 6:40 AM	Q: What makes a Chapter 61 under twenty with a 40% VA rating more deserving than a LOS retirees with a 40% VA rating? A: It is a hell of a lot cheaper the fix the Chapter 61 retirees than the LOS retirees. That, I think, is the simple reality of the situation. Note that Secretary Stanley is echoing the President’s CRDP expansion provision, something a political appointee is expected to do. Also note that the President’s CRDP 2011 budget statement and Secretary Stanley’s statement do not make it clear that CRDP will be expanded to Chapter 61’s with less than a 50% VA rating. We are going to have to wait for the actual legislative language so time will tell. It is a reality that Congress is incrementally and slowly expanding concurrent receipt programs (CRSC, CRDP, enhanced severance pay). Any expansion is movement towards the ultimate goal of concurrent receipt for all, to include those who receive severance or separation pay. As I have maintained all along, and they get a lot of good press over it. With the constant focus on the 61's they have pushed the over 20 completely out of the picture. They get off cheap, look good, those that did the 20 with less than 50 get nothin, and MOST 61's see very little increase in pay.

Posts: 63 Mar 13 10 12:06 PM	Agree that the Chapter 61 retiree will receive concurrent receipt. As pointed out it is cheaper, and designed to get political points. Sent a email to Rick Maze of Military Times, concerning the proposal of this administration. Told him that the administration was leaving out the over twenty/under 50% disabled veteran in their proposal. Rick does not seem to think so. This is what he stated: "As I have reported many times, the Obama proposal for 2011 is the same as the Obama proposal for 2010, full concurrent receipt for all after five years. The details of the 2011 legislative plan are not in the budget, but will be seen in the legislative contingency package that the Defense Department submits to Congress. I've been told by the White House it will be the same as the 2010 plan, but you can remain skeptical until we all see the actual bill language. That should happen by the end of April, maybe sooner. Thanks for writing, and for keeping me on my toes. Rick" Personally, I remain very skeptical, since it would cost 2.3 billion a year for the over twenty/under 50% disabled veteran. Rick still seems to think that the proposal covers "all" retired disabled veterans. My money would equate the "all" to mean all Chapter 61 retirees only.

Posts: 402 Mar 13 10 3:20 PM	Strange thing is when one considers the argument as provided by each "point of view", in other words the limited facts used to present the premise, then each point of view is correct. Yet we fight among ourselves, it's a shame.... We need to get the law/concept changed to correct what is outlined in this quote from the Army's CRSC website: "Since the late 1800's, retired veterans with disabilities waived their regular retired pay to receive Veterans Administration (VA) disability compensation. This system has been unique to military retirement, since all other Federal service retirees are entitled to receive their full regular retirement and disability compensation." Without changing the law/concept of disability "double dipping" then we end up with situations like each of you have presented, but from my "limited" point of view what is abhorrible is we end up with something like this little story. It is a fictional account, but it depicts way too many non ficitional serivce members--A young college graduate joins the military to serve their country, not an uncommon event. Our service member is sent into combat right after completion of individual/advanced military training. This service member is severely wounded, after medical care; this individual is “lucky” and the Physical Evaluation Board awards 100% All Combat Related Disability. Moreover, this individual is assigned to a great Wounded Warrior Battalion and their VA claim is submitted under the “Benefits Due at Discharge” (BDD) program, and concurrently another claim is submitted to Social Security under its Wounded Warrior Program. Keeping everything very “high end” let’s assume this service member has 3 years of active duty and has obtained an E-4 pay grade! Given this “best case scenario” that I have outlined for the individual, they receive: · Military Disability (Chp 61) Retirement 100% All Combat Related = $1,570* (However this is limited to 75% by law) This has to be waived in order to receive VA Disability! See next benefit · VA Disability 100%* = $2,673.00 · Combat-Related Special Compensation (CRSC) 100% = $117.55* (Requires Service member application, and not until they receive their VA rating, although it’s apparent they are entitled based on PEB findings alone)* CRSC Formula: o 1.Total amount of DoD disability retirement $1,570.00 o 2. Minus DoD retirement amount based on years of service $ 117.55 o 3. Equals DoD "Disability Pay" $1,452.25 o 4. Amount of VA compensation due for combat related disabilities $2,673.00 o 5. Minus DoD "Disability Pay" (line 3) $1,452.25 o 6. Equals Maximum CRSC amount $1,220.75* o However CRSC due is smaller amount from line 2 and line 6. $117.55* · Social Security Disability/SSI =1,100.00 · Compensation for the rest of this service members life: o VA Disability $2,673.00 o Social Security $ 600.00 o DFAS CRSC $ 117.55 o Monthly Total $ 3,390.55 This $3,890.55 is essentially all this individual can or will ever receive under our current system, and that’s a shame, no it’s unconscionable! Why can’t we give an individual like this the $1,570.00 along with the VA disability? This service member gave his or her “lively hood” to the service of their country! This is their pinnacle achievement in life--effectively it develops into; Military Retirement, Disability Pay, Social Security Entitlement, and their Replacement Income for the rest of their life! The numbers may not be exact, and I ask you to keep in mind that I used this fictional service member just as an example of the injustice of the system, I'm not trying to exclude any disable veteran...
