I have been serviices connected 20% (right and left leg) total 40% and 30% for eczema since august 2003. I submitted a c&p claim in august of 2009 for an increase in severity for my legs and sevice connection for headaches and a pituitary tumor. I went on my first C&p appt in jan for my legs and headaches. I did mention to the legs doctor that i have been unable to work for well over a year due to the severity of my legs and not bieng able to get around also occasionaly falling due to complete falling asleep ( loss of circulation in my legs from the lymphedema). Shortyl after i recieve an updated letter from VRO on which they added a claim for IU and requesting evidence of how my service connected skin condition has gotten worse. I submitted the form for IU but was confused since i hadn't recieved a decision on my claim as of yet so i didnt think i met the ratings requiremts also i had heard nothing of my sevice connection claims and i hadn't requested an increase for my skin condition at all. I was shortly sent another letter which said i had an appt scheduled for a c&p exam for my skin condition for IU purposes. I called the 800 number and explained that i was not claiming iu for my skin but for my legs i was told by them and confirmed by the examiiner that it is routine to examine all sc conditions when processing a IU claim. I was concerned however that i have been using the medication that has been prescribed to me for the last year or so and thought the conditon isn't as red it is still extremly itchy and you cant see that so will i be decreased in rating for this as a bases of this exam? Also my doctor submitted a nexus letter stating that after careful review of my SMR and current symptops that (in the va's jargon of more likely than not) my symptoms currently bieng experiencef from the pituitary tumor and headaches were that of those experienced during my time in service.Originally my case was beieng handled by the togus regional office ( i am in baltimore) the next update i recieved from my VSO was that my file had been transfered to th VMC here in baltimore and that this was good because you would rather the doctors make a decision rather than the raters? i am puzzled as to what this exactly means. Can anyone explain what happends when your claim goes to the medical center verses bieng decided by a rater? also is it standard to move forward with IU proceedings before clarifying the details of the decison on my initial claim and if they deny my claim for IU can they also decrease my skin condition rating solely based on it seemingly beieng better from constant prescribed medication use? Sorry know its a lot please help.
