I have seen and heard several ads for this; appears to be a law firm? they claim there is a new law that allows you to hire them to represent you on appeals ??? any info would help - I switched from state vso to DAV back in August, they have had no news for me since then....... The website is http://repforvets.com/

IMHO, you are better off with DAV. The outfit linked above are lawyers out to make a dime.

That bold sentence is pretty scary. Read literally, the longer these clowns take to get your claim done, the more money they make. Again, just my opinion. DAV/MOPH/VFW... all have "Vet Reps" that don't cost you a dime.

some navy guy once said "any port in a storm !!!" , so i guess if your VSO has been not successful, and your getting tired of the run arould,and you don't give a hoot about the fee , hire them !!!

I saw the commercial as well and sent them an e-mail over a week ago. My first questions was what can they do for me that organizations like DAV and Texas Veterans Commission can not. I have yet to get a response. I would have to agree about sticking with DAV and similar organizations should be your first source for assistance. Then if all else fails, hire an attorney. Remember even with an attorney you have to appeal within VA guidelines.

Keep in mind these firms only do some good once you are past the NOD level of appeal. Like Vol said, they make money from your claim taking longer. Its not like SSDI where there is a maximum they can make.

Without knowing anything about your case here are my thoughts. Take a hard objective look at your case. This is EXTREMELY hard to do. You, me and everyone else always think we are right and the VA is wrong. Remember it is all about medical documentation that absolutely no kidding meets the criteria of Title 38.

A lawyer can't do squat for you if you don't have the ducks lined up. If your ducks are lined up then do you really need a lawyer? Personally you probably would get better advice about your case and what you need for free here. Post the exact wording from the VA denial letter. That is what you need to challenge.

I doubt if the law firm will take any small case. Lets say you have $4000.00 back due, they take a $800.00 cut. They will not stay in business very long with that kind of money.

Vet10 is absolutely correct in saying documentation is the key. If you've never had a diagnosis for something, it is up to you to prove all the symptoms were present and the doctors failed to identify the problem. For example, lab test results that show increasing cholesterol levels and they were never addressed. Then shortly after separation/retirement you suffer a heart attack. Remember, the burden of proof is upon the VET.

What is even SCARIER...is the part that you left out. "and your dependents."

IF the Veteran is Eligible for Chapter 35 Benefits...will the Lawyers get 20% of those benefits, too?

Chapter 35 Benefits are currently $925/Month....So ($925)(45 Months)(20%) Equal OVER $8,300 for "EACH" dependent.

Yes...they SAY that they will NOT deduct anything from FUTURE Benefits...but what IF the Dependent(s) is/are eligible for BACK Benefits, etc.

In Addition to whatever else the Lawyers would get.

Social Security Lawyers are NOT ALLOWED to charge the dependents...when the Claimant gets SSDI benefits.

So...why should the VA Lawyers be able to charge the Dependents?

I’m sure you meant to say an attorney retained by a vet and/or claimant.

And when a vet and/or claimant retains Mr. Cheathim from the firm Dewy, Cheathim, and Howe they do get a cut from any award.

Example, Mr. Vet is initially awarded 0% for hearing loss. Mr. Vet retains Mr. Cheathim as his POA with a a direct pay fee agreement for his services. Both Mr. Vet and Mr. Cheathim file a NOD for the hearing loss. Based on a De Novo review Mr. Vet is awarded 30% S/C for hearing loss. Mr. Cheathim is now entitled 20% of the retro payment to include any amount payable for any dependents Mr. Vet may have from the effective date of the award up to the date of the rating decision.

The OGC website has addtional information regarding fee agreements and attorney represenation.

Having work in freelance in the media, and know something about advertising rates. All this advertising has to be paid by someone, it is not cheap, and lawyers don't normally work cheap. IMHO do your own claim if possible, if not find a VSO in you area to do it for you, or help you with the process.

IMHO REP FOR VETS is only going to take a big chunk of what you have coming, and if you got a tough case they may pass on you. I have asked several VSO's what to do next as my claim moved along as I have hit some major stumbling blocks with my appeal, most have said they could have done nothing more than I was able to accomplish so far on my own, my claim that is now in appeals for a rating increase at AMC, after visiting BVA. It started in 1965 with my initial filing. The VA actually a statement that they made a Clear, and Unmistakable Error, and granted me ZERO Percent back to 65 without ever see me. I will only quit, when my heart beast for the last time, and I feel the claim will soon be settled, and I will get a increase in my rating from ZERO to 20-30%.more. Hopefully with retroactive payment backs to 65 retroactive.

I will also mention when I filed my initial claim I did assign a VSO to help me, sadly they never did anything IMHO, never contact be by pone or letter. I have heard not but great about DAV, so if I was to seek help from a VSO it would be DAV. I am lucky that I have a close neighbor who is a VSO and he is only a phone call away.

It is just like veterans...... ( as a soldier we use to say your not happy if you ain't complaining).....

First veterans complained and then fought so that we were able to hire lawyers.... and now that we can ... the same veterans complain about the fees charged.... come on guys you can't have it both ways...

Good coment and alot of truth...However If a veterans org can do it for free.. After they do join them support them and the others Vets.... Not a big fan of Lawyers ( I try to hide, oh well I just told an untruth ) They do serve a purpose gor social experiments...cause there are some things never a rat won't do.

I want the OPTION to hire a Lawyer...IF I want to hire a Lawyer.

That does NOT mean that I WILL hire a Lawyer...it just means that I CAN hire a Lawyer...because I have that OPTION.

Keep in mind the saying...YOU get what YOU pay for...and THAT applies to these VSO's.

THEY...just like the VARO...get paid...whether or not your claim is Approved or Denied.

I am MY Best Advocate...but I still want My OPTIONS.

In my humble opinion, lawyers that advertise on TV and/or radio are usually the worst available. As I look at the record. many have been faulted as being less than desirable, a number have been disbarred and a few even sent to prison here in California. Reading the small print that passes so fast you have to hit pause oin the DVR tells you not to believe a word of the commercial you just saw, if you interpret it correctly. But most people never read the small print at all.

One day while waiting in line at the theatre, a man started kneading the shoiulders of the man in front of him. The man turned around and shouted "What the hell do you think you're doing?"
The first man stated he was a chiropractor, and while he was just standing in line, he thought he would practice his profession.
The other man shouted: " Well, stop. I'm a lawyer and you don't see me screwing the person in front of me, do you?"

Just some levity on attorneys....

After you jump, it's too late to wish you bought the better parachute!

As a former VA employee and a Veterans Benefits Counselor for The American Legion and AMVETS, I can tell you DON'T PAY AN ATTORNEY to do what the Service Officer will do for free - and do BETTER. I worked for 18 years as an advocate for veteran's and their dependents, helping to secure millions of dollars in benefits from the initial claim to the appeals process. Not one client was ever charge a single dime for my help. Service officers for the DAV, VFW, Viet Nam Veterans, American Legion and AMVETS are first and foremost, veterans themselves. They receive a very high level of training and are dedicated to their veteran clients. Many are volunteers and some organizations maintain full time staffed offices in your area. Are they effective? I won over 66% of appeals that I filed on behalf of my clients. The average sucess rate for veterans filing appeals without representation is less than 17%. That doesn't even count the number of claims approved without appeal because the claims were properly filed and included complete documentation. If you use "Rep For Vets", only the lawyers win.
