Posts: 1 06/05/09 18:28:28	I would like to start off by saying I have learned a great number of things through this post. This is my first time writing and hope that I am can get some answers. I am currently in the Air National Guard going through a PEB. I have a total of 24 years 8.5 of those active Army. I have taken my records to my DAV rep and he helped me submit my package to the VA. I am currently suffering from the typical Desert Storm symtoms. Nerve damage, rash, GERD, memory loss and countless other problems. I was notified the other day that I would need to see a C&P Doctor and complete X-rays at the VA. I went to my appointment and was a little puzzled that they wanted to take X-rays of my right foot.( I thought for sure it would be of my back with which I have had many problems). I was then told to see the Doctor and he told me that there was a question about a line of duty on my right foot from 1993. He examined my foot and looked at the X-rays and then told me that I was free to go. The thing that has me concered is that today I got my medical records back in the mail with a letter from the VA stating that they were done with them. I have put in a claim in on 12 different thing not one being my right foot. Is this something I should be concered with? Also because I am going through and PEB/MEB I am being told the VA will not make a determination until they get the results of the MEB? Any help I can get would be great. Thanks

Posts: 122 06/10/09 02:34:36	I don't know much about how the Air Guard will handle an MEB/PEB, but until you have your packet done that is sent to the PEB, are you not likely to have more info added to your records? In my case the VRO used my MEB/PEB documents to fill out my VA claim(s) The VA will look at things you don't "claim" if it's in your record Best of Luck, Nick

Posts: 378 06/14/09 07:26:22	Hi, Welcome to the VBN family...did you by chance send in a copy of your medical records to the VA? I did, I had copies made of my medical record before leaving active duty and I sent those to the VA...they sent the copies back once they had my original records. Just hang onto them... I don't know much about PEB/VA process...there is a thread on the board that talks about PEB's...you maybe able to get more info from that area. I do know a lot about the health issues you are talking about...I'm going into my 6th year of trying to understand and manage everything. My advice is to get educated as much as you can, and to really do everything you can to take care of yourself...the severe end of the spectrum for this is becoming bedridden, when I learned that I thought no way in hell would that happen to me, well, I'm one flight of stairs away from being bedridden. Posts: 3 06/14/09 22:31:32	Hi Susanne, Thank you for your reply the medical records that I had given the VA through the DAV rep. were copies that I had gotten from the originals only a few days old. Being that I am still in the National Guard My records are still in the clinic. I am trying to understand how everything connects with each other. Even though I have not gotten my answer from my PEB I am trying to stay ahead of the game. The places I have went for answers have been very helpful but thy usually can't tell me how their program fit with other programs. For example because I am a GS employee working for the National Guard when I am forced out of the Guard I will also loss my GS position. I researched all benefits through the DOD program and thought I had it down until I went to see my HR department. Because I am a dual status technician I was told that a lot of the information did not apply to me. I was also told that they have people that handle only cases like mine and that my records would be marked in a special way to get it to the right person. These are the thing that concern me. I have gotten answers along the lines of well if you were active duty, or I am not sure how that works with a guard member with over 20 years. I am just trying to prepare for what is coming. Should be out of the Guard and loss my full time job by November or December (Merry Christmas!) I will need to find a job that I will be able to do. I was offered a job in Germany working for a friend of mine. But here I go again how does this all work with the VA , DOD, Military, if I take the position? This sight has a lot of great information and also is great just to sometimes vent with people that can understand where I am coming from. You are being proactive and being your own best advocate...your situation is unique...keep asking the questions...maybe take it one step farther and start reading the AFI's that would apply to your status...you just maybe able to educate others about what needs to happen. So, your being told because you no longer qualify for service in the guard, you will also lose your job? That doesn't make sense to me. I understand your not be qualified for active duty, active duty requires things of us like no other job in the world...but why lose the GS job? I don't think, and someone correct if I'm wrong, that there is much the VA can do until you are discharged from the Guard...maybe why you got the records back.

Posts: 4 06/15/09 23:02:42	If you have never worked full time for the National Guard/Reserves or knows someone that does it is hard to explain. I go to work everyday in my military uniform. Even though I am a GS employee being a dual status technician has it's own rules. The only time I am in Military status is on drill weekends or if put on order during deployments or activations.There is also employees that are AGR (active guard reserve) now these employee have the same benefits as active duty. Now here is one of "those" guard things, when you are a dual status technician you must meet all Military requirements to keep your full time job. After the MEB is completed that information will be sent to my HRO office and they will inform me that I no longer met qualifications for dual status. At this time I will be able to go to work in civilian clothes for 30 days and then I am done. There is another "Guard" thing. Even though I am a GS employee I am not considered an internal employee in the DOD system. There are jobs that are advertised as internal only that I am not able to apply for because I an not considered an internal employee. I have to wait until the jobs are advertised as external through USA Jobs. These are just a few of the obstacles that are in front of me.

Posts: 136 06/16/09 05:40:37	Fleigerhorse: At one time I had a mix Active/Reserve unit in one of my commands, so I somewhat understand your position. On the Military side you need to learn as much about the MEB/PEB process as you can, and make sure you do all you can on your behalf. Brian is very correct about the experts in the MEB/PEB section on this site, it can be of great help to you with that process. Will your disabilities keep you from working? On the GS side you need to ask about your possible "disability" situation, and/or start looking for transfer possibilities.... With all that said I'm a little puzzled here, you knew that keeping your GS slot within the unit was based on holding a MTOE/TDA position within the unit, did you not consider this as a possible outcome? You need an expert in the GS MIL TECH side of things, you may need to post in other sections to see if you can find one.... Best of luck, Nick

You said that you were puzzled that I did not realize that I would loss my full time job when I lost my Military position. I never said that I did not realize this would happen. I was just explaining to Santosha1 why this would happen. As far as my GS position I have already talked to HR and they have already completed a work sheet on the disability I will receive. 60% of high three the first year and then 40% after that. I will able to make 80% of last position held without penalty. If I go over 80% all benefits stop. Also If I am able to get Social Security Disability DOD disability is reduced by 100% of Social Security the first year and 60% the following years. I was not sure where to post. There is a great amount of information through out this sight but I am trying to get through my thick skull how one affect the other. PEB/MEB, DOD Disability, Social Security Disability,VA Disability,and possibly moving to Germany to work for a friend. I know that these are a lot of different subjects but when it comes to me they could all or some apply. Thank you for your time Chuck

Posts: 9877 06/17/09 09:34:07	Fleigerhorse, Thing to keep in mind, the VA claims system while cumbersome, is NOT an adversarial system. In fact they have a legal obligation to assist the Vet. Whereas the MEB/PEB system IS an adversarial system and you need all the help you can get to ensure you get treated properly.
