recieved a letter today,telling me i'm "static" and will recieve the clothing allowance ,every year on or about sept 1st !!!

I got a question: I was declined by the Atlanta Prosthetics Department for my TENS device that is attached to my pants by a clip that has already ruined a pair of my jeans. The denial letter states: VETERAN IS SERVICE CONNECTED HOWEVER; BASED O UPDATED GUIDELINES, THE DEVICE GIVEN DOES NOT HAVE A HISTORY THAT WEARS OR TEARS CLOTHING. I have already pulled up the guidelines on clothing allowance (VHA 1173.15 dated May 17, 2007) and it says nothing about "history that wears or tears clothing." Im in the process of filing my appeal and I was wondering how should I state my case. My wife told me in writting to first ask (state) the "updated guidelines" then go into detail of which the TENS unit does wear and tear on pants (and the gel electrobs gets stuck to shirts, t-shirts, and pants and does do damage. Can someone give me some direction. Thanks

You should read the handbook again. it specifically states:

Under Title 38 United States Code (U.S.C.) 1162, the Department of Veterans Affairs (VA) must pay an annual clothing allowance to veterans if the veteran has a service-connected disability or condition, or a disability compensable under 38 U.S.C. 1151 that requires the veteran to wear or use a prosthetic or orthopedic device that wears out or tears clothing, e.g., pants, shirts, etc. (see Title 38 Code of Federal Regulations (CFR) 3.810).

also a TENS unit does not qualify for a clothing allowance:

The clothing allowance may be authorized for veterans who wear braces, rigid spinal braces, rigid cervical braces, or who use wheelchairs, crutches, rigid orthotics and/or ankle and/or foot orthosis (AFOs), ileostomy and colostomy appliances or similar devices, or who use certain skin medications and/or ointments.

is the reason you were given the tens unit ,because of a SC disability ??? if yes then appel if not ,i don't think you will get it ,as you have to have a prostetic because of SC !!! good luck !!!

just , thinking out loud, but would those soles and shoes cause clothing damage ??? i don't know, you do, what clothing damage could you give them ??? that is the only thing i can think of as far as the clothing allowance is concerned !!! when in doubt, file for the C A , and let them deny or approve !!! good luck !!!

I wear a supra-pubic catheter which leaks once or twice a month staining clothing, sheets and rugs. Medication required to treat recurrent infection of service connected condition is the cause of the staining. Does this qualify for a clothing allowance?

i don't know but it's a simple thing to fill out an application and send it in ,they'll notify you of their decision !!!

one check a year , roughly $716.00 i got a check the last three years , had to apply every year, but got the letter this year , saying i was "static" , check usually comes aug 31st , thru end of oct !!!

How long did it take you to become static. I was told I was approved for clothing allowance for the amount $716.00 but have not received a check yet? Did you have to go to the VA once a year to apply for the 716.00 clothing allowance and then it becomes automatic or what after 3 years? Please reply.Thank you.

yes, i applied for three years, got a check every year , then recieved a letter this year ,telling me i was "static" and no further app's were necessary, i wpould automatically get it every year, unless there was a change in my health !!! if you were approved in 2009 , (summer ???) i would call the prostetics dept in your VA hospital and speak to the person who handles the applications for clothing allowance and ask him where the check is , also ask him what it takes to be deemed "static" !!! good luck !!!

Hello everyone, I filled out the clothing allowance form and submitted it in time and received a denial letter today. I have two back braces with metal strips in them that I received from the VA for a sc disability. Does the back brace qualify? and or there any tips to appeal this decision.

I use a wheelchair, and leg braces..... I'm 100% PT SMC of M and considered homebound...

would rather you were healthy ,but,yeah, that's why,sounds like a home run, !!!

i'm also 100% PT, with SMC M & S !!!
