Posts: 105 Nov 22 08 7:36 PM	Tags : None My diabetes physician provided me a letter after doing several medical tests and stated due to diabetes (which is service connected) that I have moderate incomplete paralysis of both hands and feets due to peripheral neuropathy (PN). The VA C&P Exam also said I had PN, but also stated "no medical opinon requested from VARO". Does anyone know how this might be rated and under what dianostic code? Will my doctor's opinion be conclusive for the rater? Thanks Dave

Posts: 17433 Nov 22 08 10:54 PM	It sounds like the purpose of the exam was to determine the severity of the condition rather than to obtain an opinion on service connection; therefore, apparently that decision has already been made in favor of service connection. This isn't unusual as this isn't something that VA generally questions. This is fairly common and does not involve anything that is unique or controversial so there would be no reason to question your doctor. Cruiser

Posts: 105 Jan 2 09 6:23 PM	I need help with the above claim. I just received service connection for PN, upper and lower, but at 0%. However, no where in the decision letter is there a reference to a letter my doctor provided that said my PN upper and lower was moderate incomplete paralysis. I don't belive the rater saw it becuse the letter is not listed as evidence used in the rating.. I have a copy of the certified receipt and an IRIS response that informed the VA the letter was on the way. The VA got the letter over 30 days before the decision. I know I can appeal, but should I ask for a de novo DRO Review? Is it a CUE to overlook a diagnostic letter from a physician? Thank you. Dave

If I have learn something here is that the rater will execute a judgmental call; now like cruiser said a decision was made, he just whant to now "the severity" of the condition. Posts: 106 Jan 5 09 3:55 PM	Dave1027, I went through almost the same exact scenario that you are going through. The rater did not consider two documents that were in the package and it changed the rating by over 40%. I did file an appeal with a DRO review. It took me almost two years but the appeal was successful and it was back dated to the original date and resulted in a 100% rating. This is something that you definitely should do. I do not believe that yours will take as long as mine as the backlog is not as large as it was when mine was in the process. Badeye

I also had a similar circumstance. Although it was not mentioned in the rating, I had previous correspondence from the DVA that they had received my DVA doc's letter. I filed for a DRO review and a C&UE was determined to have occurred. There are other conditions to have a finding of a C&UE but your claim seems to be in that ballpark. Search this forum for references. Cruiser has discussed it several times before.

Posts: 105 Jan 10 09 9:03 PM	My service officer found my letter with the Triage team who FAILED to give it to the rater. He said since it is within 30 days of the rating, the letter will be added and reconsidered. So, I have to wait longer due to a VA error. Probably not the first time this has happened and certainly not the last. Frustrating at the least. Tick Tock Tick Tock the waiting continues. Dave
