Claim for hypertension secondary to Agent Orange exposure |
Lead | ||
|
My question? What are my chances of getting rated for hypertension if I didn't have hypertension before active service, but when given my discharge final
physicial exam, I had a reading of Pre-Hypertension of 132/88 and have had hypertension ever since. I take four medications for hypertension daily.

None, based on what you've said. First of all, hypertension cannot be secondary to Agent Orange exposure, because exposure to Agent Orange (herbicide
really) isn't a compensable condition. It could be secondary to some other condition but, you haven't suggested anything.
Last July in their Veterans and Agent Orange: Update 2006 report. the IOM states Hypertension and Amyloidosis had limited suggestive evidence of a link to herbicide exposure and the Secretary of Veterans Affairs formed a group to evaluate the IOM findings. From preliminary reports it looks like the Secretary will add amyloidosis to the list of conditions presumptive of herbicide exposure (38 CFR ยง3.309(e)). It looks like he chose not to add hypertension to the list..

Received an interesting message from the VA today. It it they stated, " . . . . in reference to your Hypertension claim. We have not been officially
informed about any new decision by the VA Secretary dealing with Agent Orange presumptive service connected issues.
It seems the AO Hypertension consideration may still be an open question. I also talked to them on the telephone to confirm this.

I think someone didn't get the word. There's a document out covering this. It's over.

if the secretary approved it, their would be a half a million new claims, so .........i doubt it will be added to the preumptive list !!!

The Texas Veterans Commission, the NVLSP and our very own adder are reportung the Secretary added amloidisis but rejected adding hypertension to the list of
presumptive conditions of exposure to herbicide.
That's sufficient evidence for me, I don't need to be hit over the head with a brickbat before I get a clue. Some folks seem to need that so here's a link to what the lawyers at NVLSP have to say about it: http://www.nvlsp.org/Information/ArticleLibrary/AgentOrange/AO-RevisedAgentOrangeRelatedDiseases.htm The next anyone hears about this will probably be a notice in the Federal Register.

mjg, you might want to file a claim anyway. There is a chance for s/c for the hypertension depending on what the medical records covering the 1st year after
service show - hypertension is one of the diseases that can be presumed s/c if diagnosed to a degree of 10% or more within the 1st year after service.
Naturally if you served in Vietnam and left the service in the late 60's or early 70's any records may be long gone.
Good luck! |

Its too late now, I have already filed the claim, so maybe it will take a miracle to get it granted, but I have no choice, but to wait for a decision. Thanks
for your comments, I always appreciate any help that is available. Thanks again
