March 2014 – BVA Travel Board Hearing
May 2014 – BVA granted service connection o Combated Related Restrictive Lung Disease
October 2014 – Restrictive Lung rated @30% [combined with previously rated COPD @ 30%]
October 2014 -- NOD filed -- requested 100% due to supplemental oxygen use
January 2017 – DRO hearing at VARO
May 2017 – Letter sent from VARO which included February 2017 rating decision granting 100% service connection for restrictive lung disease effective May 2008
May 2017 – Requested CRSC increase from June 2008 to October 2010 [During this 9 year odyssey I have been service connected for IHD at100% effective October 2010. Thus, the major effect of this new 100% decision is to give an earlier effect date for 100%.]
Although I have not yet heard from the CRSC Board [they said it could take up to 90 days for a response.]
Is there something about a “6-year rule”?
Since the process of NODs and a formal appeal took more than 6 years, can I assume that there will be no retroactive payment.
