Been IU since 05 Got a Va 21-4140-1 today to fill out from the VA . Is this standard do you all fill this out yearly or is this something new?Do you recommend after filling it out should i send it 1 class mail or cetified it or can you call it in or fax it .Thanks inadvance.

I got mine last month and did not mail receipt signed.
I will next year because like regulations say if they don't get it you could be denied benifits.
It's a few bucks for peace of mind.

I received mine today. I will be sending it out by Registered mail, Return Receipt.

Also, I will be sending a copy to my VSO so that they can put one in my file, and give a copy to the VARO...

You can never be to careful on this one......

Still waiting to get one. 100% P&T (80% w/IU) since 2000 and never got one yet. However if and when I do get one it will be mailed certified with return receipt; as I send ALL VA coorespondence. Too many times I have sent coorespondence to VA and they said they never got it. Many of these were cert w/ return receipt too. CYA.

I suggest you save your money. If for some reason VA doesn't get it or loses it, they will send you another one. Although they will also "propose" to terminate your IU, this is simply a way to get you to follow up. You will be given a minimum of 60 days to submit the form. You won't be denied anything, provided of course that you send in another form.

It won't matter whether you have a postal receipt showing that they got it or not, you still have to complete and submit another one so you haven't really gained anything by getting that receipt. After all, it isn't the receipt of the form itself that is important but rather the information on the form. If you do have to follow up with a second submission, then you might want to get the postal receipt on this one.

Considering the back log that VA currently has, just think what it will be if everyone sends everything in twice, once by mail and again by fax. This will needlessly tie up file clerks, mail clerks, and Veterans Service Representatives before they realize the second one received is simply a duplicate of one already processed. They already process a ton of incoming mail a day and this would simply increase that burden.

Abstract: Claimants who are under the age of 60 and receiving
individual unemployability, compensation at 100 percent rate are
required to complete VA Form 21-4140 and 21-4101-1 certifying that they
are still unable to secure or follow a substantially gainful occupation
because of a service connected-disability. VA will use the information
collected to determine the claimant's continued entitlement to
individual unemployability benefits

That's true that would create a backlog, but we have to defend ourselves as well. Got a better suggestion beside they telling us "we did not receive your form"? Your talking about our life here.

5.08 CONTROL OF EVALUATIONS BASED ON INDIVIDUAL UNEMPLOYABILITY

Prior to October 1, 2005, if a veteran was assigned a total disability evaluation based on individual unemployability, BDN would automatically issue an annual letter (VA Form 21-305) reminding the veteran of his/her responsibility to immediately notify VA if he or she returns to work. Effective October 1, 2005, an employment questionnaire will be issued to this same category of veteran for a period of 19 years or until the veteran reaches age 69, whichever comes first. BDN will automatically establish controls for the return of these questionnaires. The Income Verification Match will also monitor the veterans employment status. See M21-1MR, Part X, Chapters 9 and 10.

a. Exceptions. Controls under this section are not required in any of the following instances:

(1) The veteran is 69 years of age or older;
(2) The veteran has been rated totally disabled for a period of 20 continuous years, which protects the evaluation from future reduction under 38 C.F.R. 3.951(a); or,

(3) The veteran is assigned a 100 percent schedular evaluation.

Note the age at which the form is no longer required--age 69 or older.

Your postings are the wisest counsel I've found. I've been IU since 03. In April I too received a notification the VA proposes to discontinue my entitlement to IU because I had not sent in a VA Form 21-4140. I sent in my 21-4140 to the VA that very same day.

A week later I followed up with a letter to the VA that included a self addressed envelope asking if the VA could tell me if they had received my Form 21-4140 and if it fulfills the requirements for continued IU Benefits. It has been 3 weeks and so far I have received no response.

I've read where you say the VA sends these Rating Decisions as simply a way to get you to follow up and we shouldn't needlessly burden and tie up file clerks, mail clerks, and Veterans Service Representatives by sending everything in twice.

But the Notice of Discontinuation and Rating Decision are quite alarming. It talks about how I only have 60 days to request a personal hearing, obtain representation and submit medical evidence.

Any suggestion on how I might check to make sure I've done what's necessary so that my IU is not is terminated
