Rookie VBNer Posts: 35 Jan 16 08 1:49 PM	By this action the DVA "It's my personal opinion'" that they (AMC) intentionally are delaying most of the time-the process to handled and resolve all veterans appeals and claims decisions. My claim-appeal were remanded to the AMC. The BVA, out of three issues, granted me s-c for my 1. GI disorders and remanded 2. Cervical Spine Disorders and 3. Psychiatric Disorders issues. This is funny the AMC divided this appeal to be processed and divided in two sections. AMC sent for a C&P examination for my GI issue for rating purpose that was 2006-2007 one year already. For the second part: They sent for the two remanded C&P examinations in Dec 2007 - remanded issues left behind, Cervical & Psychiatric disorders. My point or another question here is, way the AMC did not sent for all three C&P examination at the same time. This is not right, dont fell right to me, because this means at least one more year to complete this case. lugupa1166

Posts: 17419 Jan 16 08 9:14 PM	When BVA granted the GI claim that was no longer part of the appeal since this claim has now been granted. As such it generally would not be processed by the same people who work appeals. Since this issue likely involves payment to you the remand would have been sent to the Rating folks first to determine the degree of disability from the GI condition (which likely means a GI C&P) and to grant you any monetary benefits to which you are entitled. Like I said, the folks doing this usually aren't the same folks who will process the issues still on appeal. This is likely why the granted GI claim was processed before you heard anything about the other issues. What "logical" reasoning could you give for any VA office deliberately delaying the processing of claims like this. All VA offices, including AMC, are evaluated based on how quickly and how accurately they process claims. If an office does well there are potentially some big bucks in bonus money to the executives and some smaller bucks in bonus money to the rank and file employees. In addition, those individual employees who process the work the fastest with a satisfactory degree of accuracy can get additional bonus money. So with this in mind, why on earth would any VA office intentionally delay processing claims? I spent over 30 years at a VA Regional Office and as much fun as you think it might be to sit around and screw with veteran's claims, it's not nearly as much fun as working them as fast and as accurately as possible in order to get a chunk of that bonus money. Spending that money is a lot more fun than playing with claims. Heck, it bought me a couple of Harley-Davidsons. Cruiser

But in 1998 I had all three C&P examination on the same week. And for these issues I been on the road for 10 years, that is why I come to this site to find understandig and relief. My guess is that there is nothig wrong with that too? Cruise, you are the expert with 30yrs of service, any logical reasonig coming from me would never compare with you and with your experience I know where should I stand. 10 years compling and with VA regulations and seen baby's steps on my claims, put me at a defence mode. Hope you understand. Most of the time I have been going with the flow; also b/c for a very long time I knew and understood about the system over-load. Started dealing with the VA since 1989 before both Gulf Wars. If I most have to give more time, and or to give up any of mine schedules appointments for any of the fellows service members coming from Iraq and Afghanistan's I have no problem with that, dont even need to think about it. But when you fell that you have done your best in order to support your claims and you see there is an error after an error dealing with you claim then you star questioning. Also we all know that the real fact is that the money where is need it is overseas, in order to support our troops and today we also know that funding for the DVA needs fall short more frequently than ever. lugupa Edited 3 times by lugupa1166 Jan 17 08 5:34 AM.

Posts: 35 Jan 18 08 5:20 AM	I had my claims for my service connected disabilty completed within six months at the 100% P&T level. I knew before I retired that I was going to file for my service connected disability. Unfortunately, a lot of veterans (non-retirees) are just anxious to get out of the service and don't get their medical records in order before they are discharged. Years later an injury that was bothering them when they were on active duty returns and then they try to file for compensation, especially if there has been a period between discharge and the medical problem happening again. So good luck to you, it's not the VA is out to screw you, it's they want to cross the T and dot the I because although Congress wants the vets to get the money, if their is a mistake they're going to come down hard on the "laxness" of the VA approval system. Afterall, it's just politics and the claims processor is in the middle doing his job.
