To the Legal/Financial Experts concerning CRSC.... (brian, sgt mack, retired99)
Veteran received VARO original award letter in early February 07. This award granted disability compensation for
cancer. (Temporary 100%) from 01 Mar 06 to 31 October 06. Vet also received full retirement pay for this entire period of time.
I would think this constitutes an overpayment. I can't figure if she is overpaid by the VA or the Navy.
Rating was decreased to 70% effective from 01 November 2006. She received a direct deposit for the temporary 100% pay
for 8 months. Veteran began receiving 70% VA disability pay 1 Feb 07.
Retirement pay with VA waiver began in Feb 07 also.
CRSC approved in Feb 07.
100% CRSC effective from Mar 06 to Oct 06.
Total Combat-Related Disability is 70% effective Nov 06.
"CRSC notification letter of 25 Feb 07 paragraph 3 says vet cannot receive CRSC unless they previously elected to waive part of their retirement pay in favor of VA disability pay."
Does this paragraph mean when no (va waiver) money is withheld prior to the approval of CRSC, that payment of CRSC is not permissible in any of these cases.
The legal/technical question that has us baffled is concerning the above info
about para 3 of CRSC approval letter. The veteran did not waive any part of her retirement during March o6 through
October 06, because she was not aware of this being a requirement. Does this
mean that no CRSC pay is allowed for this period?
Regret having such a long question, but the Veteran is worried sick AND she is stressing out like you won't beleive.
