Almost six months ago I received a BVA decision on my VA claim I submitted a month after military retirement in early 2007. I appeared in front of the BVA judge a year ago. The major issue was granted by the judge with two other issues remanded. The two issues remanded were examined by a VA doctor on Memorial Day. The doctor stated in writing that both issues were as likely as not service related. I recently received a letter from the Appeals Center denying both issues stating they did not have to agree with the VA physician's statements or results of his examination. I then called the BVA office and they stated the Appeals Management Center does not have the final decision on the remanded items, the BVA judge does. I wrote a letter to the Appeals Center disagreeing with their decision. I am just wondering who really has the authority and whether or not the AMC decision really has merit.
