Re: Follow up C&P (reply)
If your conditions have not improved then your ratings should stay the same.  The VA does not try to try to lower anyone.  The rater goes by what the C&P doctor reports.  Good luck.

Re: Is this true (reply)
If your condition has gotten worse then you would file VA Form 21-526 for the increase in compensation.  Personally, I would run this through a VSO and I would check the criteria required to get the claim rated at the next higher level...

Re: What am I looking at when I ask for reevaulation for cervical and lumbar? (reply)
It will be based upon ROM.  You already are SC'd for the condition, so, the information from your MRI really does not impact your condition.  The doctor will look at the Range of motion in your back.  If your ROM is OK, then you are...

Re: Porposing Rated Reduction from 90% to 80% (reply)
Some comments on this thread from Cruiser:I see that you posted in this thread.  I'm surprised that no one has picked up on what was fairly obvious to me.  If reducing the 30 percent evaluation for flat feet to 0 percent dropped his...

Re: Quick Question (reply)
You are not going to die from tinnitus and it will not likely result in a SMC rating, so, what will it do for you?  It may result in the reopening of all you other disability ratings (as already stated by Mac).  Your call.

Re: WHAT DID YOU DO DURING THE WAR DADDY? NOTHING I STAYED HOME AND SENT OTHERS. (reply)
I don't think I want any more Americans dying in distant lands when the Europeans won't get involved.  We can send in aircraft and let some other nations take over ground operation, but we know that will never happen.

Re: Denied Fibromyalgia VA Claim (reply)
I believe this is a C&UE.  The Regulation is very clear and you meet the criteria.  It is not a matter of opinion as the rater did not follow the directive.  So, unless I am missing something, there is clear evidence that you should...

Re: Denied Fibromyalgia VA Disability Claim (reply)
Docking at a port would not matter as the "Red Sea" is identified as a "Gulf War" Area.b. Gulf War Veteran. The term "Gulf War veteran" under 38 CFR 3.317 means a veteran who served on active military, naval, or air service in the...

Re: What I thought was a hearing turned into a review. (reply)
Not uncommon.  The VA was looking at (if this was a C&P exam) the IU but also at the possibility of raising any other disability percentages.  Quite often a person will put in for IU because a specific disability keeps them from...

Re: Homeless Man Savagely Beaten by Philadelphia Mob Because Of A Child's Lie (reply)
Although violence is way too common, it is often perpetrated by folks who live in the inner-cities.  They show no restraint and do not respect the value of human life.  Check out to UCR to see the stats.

You understand that if his treatment notes state what you are trying to get him to fill out on the DBQ, that the treatment notes are just fine for claim purposes?

The pain is not a factor but the ROM is.  Two things, he may have observed you bend in the chair in the C&P exam room or in the waiting room and made a guess, or he forgot to do the check (kind of hard because the form walks him...
