Re: Appeal of FDC? (reply)
Let it go and you can always submit the evidence in an appeal or DRO review request.  Do't fret about it and follow your VSO's advice.

Re: IU/Voc-rehab and working questions/Advice? (reply)
If you are looking to work then you do not see yourself as qualified for IU as you believe you can work.  If you took the job, as soon as the VA was made aware of the job, you would likely lose the IU (And rightfully so).

Re: How do I get a copy of my C&P with a private doc? (reply)
Actually, the C&P is the property of the RO and you will need to contact the RO to receive a copy.  Past threads have indicated that the ROs have not been releasing the C&Ps until a decision has been rendered.

Re: C&P Exam VS IMO during DRO Review (reply)
Here is some clarification on IMOs from Cruiser:With regard to this thread   http://vets.yuku.com/topic/136098/CP-Exam-VS-IMO-during-DRO-Review   if it was actually an IMO then the decision would be based on that opinion; however, I...

Re: How do I prove depression is SC on VA claim (reply)
Can you identify an in-service stressor that made you fear for your life?  The reason I ask is that the symptoms you listed are the same for PTSD as for MDD.  The MDD after ten years without any notes in your SMRs will be difficult to...

Re: 5 Year Review??? (reply)
If you have not been called in for thirteen years then you are most likely P&T.  Your service connection for all of the disabilities that have been being paid for thirteen years are protected (absent fraud the VA cannot sever service...

Re: Back pay if you missed the 1 year appeal date (reply)
The letter from the service just being located late would not have any impact on the VA.  Further, by missing your appeal date, unless you can somehow show Clear and Unmistakable Error, that bus has left the station.  The information on...

Pastorlee, In the future, if you (or anyone else who reads this post) are posting a lot of data, please break it up into short paragraphs with spaces.  That makes it easier for some of us older folks (and the younger ones who will admit...

Re: C&P Exam VS IMO during DRO Review (reply)
Who did the IMO?  If it is one of the well known hired guns then the VA will likely go with the C&P doc.  Wait for the BBE for the results, it may be in your favor.Good luck with your claim.

Short of a Tracheotomy, 50% is the max for SA with a CPAP.  Good luck going forward. 6847    Sleep Apnea Syndromes (Obstructive, Central, Mixed):                     Chronic respiratory failure with carbon dioxide retention or cor...

Will the doctor opine that the lung cancer morphed into the pancreatic cancer?   It is worth asking the doctor for his opinion.

That is a big issue.  While intervention by the Administrator may help out the complaining vet, it pisses off thousands of other vets who wait patiently in line for their turn.  Further, it demonstrates that the squeaky wheel gets the...
