My latest claim for Bilateral Pes Planus was denied on 01/12/2012 per e-benefits (Original claim was submitted back in October of 2000 and also has a final denial). I am awaiting the official denial, because e-benefits is stating that my claim for an undiagnosed illness for a bilateral foot condition was denied due to no evidence of serving in combat during Desert Storm. I have a copy of my 4138 (date stamped) that I submitted to the VARO for pes planus, and I am beyond livid that something like this could happen after months of awaiting a decision (I never received a duty to assist letter about any undiagnosed illness claim to be developed). Of course their decision is final, and my question is should I again ask for a review de novo with no new or material evidence as of today, an appeal, or CUE? I have multiple diagnosis of pes planus in my SMR, treatment for bilateral foot pain in my VAMC MR, a diagnosis in my original C&P via x-ray, and residuals...
