I took the SSB in June of 1995. The lump sum was around 24k. I only got a check for about 16k because they witheld taxes (that is a heavy percentage to begin with). Later, after I was discharged, I was awarded disability, and con-current reciept took effect and so there was recouping. Fine. Now as I thought I reached the payback amount, I'm being told that the VA has to recoup the gross amount. Not-Fine. I wasn't paid the gross and then taxed on it as income, I was only cut a check for the post-tax amount. Surely this makes no sense to any resonable mind. I received around 16k, and the gov't took the rest. I am entitled to a 10% disability check and the VA has to recoup the money from ME?! Money that I never received? Am I missing something here? Can they really be telling me this? There must be some recourse? They can't take the same money twice?! Can I write it off as a loss? That is just theft to my understanding. I read the CFR, but what is the difference between before and after Sept 1996? Can anyone tell me I'm missing something here...?
