Posts: 1 07/14/08 13:51:31	Greetings all. I'm new here and have a question about a claim with the VA. I filed the claim back in August 2007 for pneumonia induced asthma. I had the C&P exam here in Germany on 30 April and was wondering how long it takes before the VA makes their decision on a claim in general - any idea? The US Consulate indicated that they had sent the exam results to the VA on 12 June by email. Also, would the VA send me to a C&P if my claim were to be denied anyway? I've written emails to the VA regarding the claim status, but receive no reply. Appreciate any feedback! Last Edited By: kerpal 07/14/08 14:18:58. Edited 1 time.

Posts: 204 07/14/08 21:35:50	First welcome to the Board. The only comment I can make to you is that VA is working on it. To be realistic no one can tell you the time the rater may take to make a determination on your claim. When they send you to a C & P exam it means that more medical information is needed. This do not mean that your claim is goin to be approve or not. Only the doctor, will give his opinion on your condition. Only the rater who handle your claim base on what the doctor diagnose will make that final call. If you make an iRIS inquired will take at least 5 working days some time litter longer. "LIFE IS A SERIES OF ENCOUNTERS AND FAREWELLS" evw and true them we grow and became more mature.

I did an IRIS inquiree yesterday. If your's is at the Rating Board, rating decision could be within the next 90 days. I had mine at the Rating Board and they sent it back for further development. That held it up further. Most of my claims are in the NOD stage at this point and I have submitted more new evidence. I get tired of this after a few years. My claims are now over 3 years in the progress.

Posts: 4 07/16/08 09:56:00	Possibly another 90 days for the Rating Board? Goodness, I never thought I could be so patient. I received a copy of the bill that the Doc in Frankfurt had sent to the VA - $3300 for the examination. It just seems illogical to waste so much money and be denied in the end anyway. I'll just have to wait and hope. My Iris inquiry for a status check took 14 days - much more than the 5 days indicated on the VA website. I've also requested a copy of the C&P exam from the US consulate, which I will receive tomorrow. Curious to see what the Doc determined. Kerpal

I sent them an IRIS query on June 26, 2008 asking about my claim status. They responded by telling me they had received new and material evidence on April 14, 2008. They also advised the claim had been opened on January 15, 2008. Mind you I had the C&P Exam on Sept. 11, 2007. None of the VA's dates make any sense to me. Anybody got any ideas?

Hard to say until you get your decision back. I once had a decision that indicated in three different places a different effective date for my claim approval (one was even in the future). Attributed it to work overload and poor quality control.

Once you have your C&P it works fast about two months in my case in the past. It all depenes on how busy they are and if they have all the info. they need to rule on your case. Welcome Home Kenp

Welcome Home Kenp I'm trying to remain positive about this, but it is becoming more difficult as the processing time reaches 1 year next month. But, we should all be used to that 'hurry up and wait' mentality

Posts: 6 07/19/08 06:33:33	I received a copy of my C&P exam. The exam was conducted by a doctor here in Germany that is under contract to the US Consulate to perform C&P examinations. I found that the verbalization of the results leaned strongly against the required factors for a positive claim, almost as if this were formulated intentionally to ensure a denial - a very subjective addition of findings. I base this on comparison to my personal doctors report - big difference between the both. I have this irky feeling that the VA will favor the contract doctors report. Any similar experiences in this regard?

They concede that I do have asthma, however they are of the opinion that the pneumonia 'most likely' is not the cause of the disease but rather weight and allergies. Depends on how the translator at the VA formulates the translation. The FEV results were 72% and I inhale oral bronchodilators and anti inflammatory meds numerous times each day. While I was still active duty, the Army docs put me on high doses of prednisone which cuased cataracts in both eyes. I had surgery in the mean time and had this corrected. I caught the pneumonia from a fellow soldier while on active duty and ever since I've been asthmatic. The reference to weight is irritating, as I became asthmatic when I was active duty - and I was slim and trim back then. I've gained weight since then ( who doesn't) but it's not like they refer to. Posts: 27 07/20/08 01:42:04	Something about contract Dr's that bothers me. I have always been seen by a VA Physician. Having a C&P Exam overseas bothers me. I guess this was done by an American physician who lives overseas. Too many issues there even to begin to go into. I think I'd rather fly to New York and have one of their Docs do me. On contract to the US Embassy? He wants to keep his contract and tubes every vet he sees. Too many issues even to begin to go into.

Get statements from folks who observed you have asthma attack right after you got out the service. The sooner they saw you have it after you got out the better. Folks other than the family (more objective) are better. Teacher, lawyer, CPA, Police officer. Somebody, if possible, with a title. They can't say it was asthma (they are not a Doc), they need to say what they saw the gasping for air, etc. How often. The key is how soon after you got out. If it wasn't right after you got out, probably ain't worth spit. Well, that is my 2 cents. Should get my copy of my C&P report next week. Will see how that goes. Best of luck to you. The only supporting document I was able to submit was a witness statement from my ex-wife. I have racked my brain and the Internet as well, and just cannot find anyone who actually remembers my asthma problems, as this was 23 years ago. I left the service in 1986 and went back on board as a GS civilian, continuing treatment at the same Army medical facility here in Germany. The base closed down in 1995. All civilian medical records were allegedly transferred to the Hospital in Heidelberg. I sent them a request and they cannot locate my civilian records - poof, they're gone. Only the military records remain and the VA has those already. I started working for the German economy in 1994, where my asthma treatment has been documented by my private German doctor ever since. The VA has a statement from my German doctor, listing all meds, attacks and treatment - serious steroids and cataract operation both eyes as well. I am also rated 50% handicapped under German law for my asthma. I don't know if the VA will recognize that German rating or not. I'm still trying to remain positive about this, but the hope is becoming less and less... Kerpal
