Also, more weight was given to the C & P Exam Drs, than my 10 years of medical records submitted or my private medical Dr whom I've been a patient of since I got out of the Military. Do lots of you here see this happening?

Review C&P Exam Report? |
Lead | ||
|
I've been reading where people have gotten copies of this and or reviewed them. How do I get access to mine? Is that only if it is done at the VAMC? Both
my C & P Exams were done by QTC Drs.

kalbi wrote:An exam done for the VA Regional Office is the property of the Regional Office and the party doing the exam doesn't have the authority to release a copy of it to anyone. I doubt that they even keep a copy. At one time some VA Medical Centers did not even keep copies of these type exams in their records as they are not part of the treatment file; however, most VAMC's, if not all, will now release a copy of the exam to the claimant. For a contract exam like you mentioned, you will need to request it from the Regional Office. I would just request a copy of the claims folder which will include any C&P exams along with everything else that is in there. You are entitled to one free copy of everything. And with regard to that comment about a "denial template", just ignore that because there is nothing to it. All C&P examiners are given an outline showing exactly what information is needed by the Rating Specialist depending on the particlar body system or condition being examined. For example, for an orthopedic examination of a joint the outline instructs the doc to provide various ranges of motion and to put the results in a specific format so the decision maker knows exactly what the doc is reporting without resorting to guesswork. Such outlines have been used for disability evaluation examinations for many years, not only for VA but for just about any other company, agency, business, whatever that is paying to have someone examined by a doctor. When I went to work at VA in the mid-70's the outlines for the various exams were contained in a book called the "Physician's Guide" or some such thing, and the copy they gave me was very old and tattered so it had been around for quite awhile back then. When my ex-wife undergoes a review exam by Social Security the doctor is sent an outline showing what information Social Security is looking for so they can make a decision without guessing at what the doctor is saying. To refer to something as benign as this as a "template for denial" is nothing more than paranoia so just disregard that. Cruiser |

For a C&P exam at a VA Clinic conducted by VA Doc's:
1) Can they give you a copy or do you need to go to the RO? 2) If you have to request it from the RO will it slow down your claim? Thanks in advance for your help!!!

Vet 10,
I'm not Cruiser but when I had my exams done (some at the VA hospital and some by contract doc) I waited a couple of weeks, went to the records section at the hospital, signed a release form and they handed them to me. Hope that helps. Daryl

kalbi,
Please be careful of anything TDIUvet tells you. He has proven over and over that his "knowledge" is doubtful at best and most probably dangerous at worst. As someone noted in another forum when he starts using different colors and bigger text he is really blowing smoke trying to cover for his lack of real knowledge.

kalbi,
Everything in this thread is good advice no matter how bold the print or the color of the statement. It would be best to wait until you receive your rating decision before you send in a request for information. You don't want anything to interfere with the decision process. I'm not saying a request would interfere, but why chance it! As soon as you receive the big brown envelope that will change your life, for the better is the hope of us all, then write a letter to your RO and ask for a copy of your C&P exam and they will send one to you as soon as they can. All the luck SC |

Pilot,
My question to Skinny Cat is based on his comment: "Everything in this thread is good advice no matter how bold the print or the color of the statement." If he believes that everything in the thread is good advice that could imply that he also believes the statement about denial templates. I personally do not believe these templates exist. But I am also willing to look at any credible evidence to the contrary. Hence my question. |

C&P results | #14 | ||
|
I have received via mail two of my C&P exam results just by asking at my VA local hospital when checking in at mental health for an appointment. The
receptionist at the mental health desk just has me sign a release and she forwards it internally through the VA. I get my results in about a week and a half
in the mail.
She probably doesn't have to do that, and I'm sure there is an information office, but she sees me there every two weeks if not weekly and I think she empathizes with vets. There are some really caring VA employees out there. I always get my C&P results, I learned that here. I learned allot here, we all have. |

( I always get my C&P results, I learned that here. I learned allot here, we all have. )
I two have allways been treated well at the VA and have not had any problems getting my proggress reports or c&p results. my report from MH took a little longer I think they had to get aproved from Doc frist not sure. The last time I had C&P they asked me and otheres to fill out a form on how well they were doing. I go to Memphis VA an in my books they are the best. I would not be alive today if it was not for them . The only problem I have ever had was at the ER and then it was not the doctors but a clerk that must of had a bad hair day. As for this board goes everyone has a back side and we all show it sometimes some more then others ! Thanks for all you
do here or try to do here.

I received all my hubby's records from the VA simply by requesting all the records, military, medical, exams, etc. under the "Freedom of Information
Act." That is what I was told to put in my letter to the VA and also to write FOIA on the outside of the envelope. My adjudicator friend directed me this
way and I had no problem getting them. I went direct to the Department of Veterans Affairs where my hubby's file was located, not the medical hospital. Now
that he is a rated disabled vet, once a year he goes to the hospital and requests his records for that year and has no problem having them printed out for him.
Hope this helps.

http://www.va.gov/vaforms/medical/pdf/vha-10-5345-fill.pdf If you have Acrobat Reader you can copy this to it and fill it in online and print it. Or Go to here: http://www.va.gov/vaforms/search_action.asp?Next10=Next25+%3E&formno=&tkey=Release+of+Informtion&CurrentPage=1 And get a copy of VA Form 10-5345 and send it to the VAMC that you use for your medical or mental health treatment. Same applies for medical and mental health information from the Regional Office. When asked for your reasons for wanting your files, I would suggest putting "Continuity of Care" http://www.va.gov/vaforms/va/pdf/VA3288.pdf For all other information including your Claims file.
