Posts: 18 06/28/08 23:58:48	Hi all, A friend of mine is 40% disable for a serious knee issues he suffered while avtice duty. He is having trouble finding any work due to the fact he cannot stand for longer than 10 minutes at time. He is also prescribed some pretty heavy meds to deal with the pain... Just wondering how he can go about trying to get IU for his issues. Like I said, he is 40% disabled per the VA but is in the process of appealing this decision. Thanks in advance....

As for not being able to get a job, if it is totally related to his problems standing, he should use voc rehab or gi bill to try to get trained for a career he can do. Lots of people with physical problems- even those requiring wheelchairs- get jobs. But if it is the meds causing most of the employment problem, he might need to service connect that individually.

My IU is based on bipolar, period. Not the meds, not the side affects. If during the fed voc rehab evalu they state that there is an issue for the medicaitons, then he might be able to go up and have his claim reassessed. PO Blueeyes

Rookie VBNer Posts: 7 07/01/08 20:15:31	The first thing your friend must do is decide if he wants IU or work. If he thinks he can maintain work the voc rehab program is really great! They will find what your strengths are and find a job for you or send you back to school for more training. They also have the work study program that pays you minimum wage but its not taxed and you pretty much set your own working hours while your attending school. While in the program you will be paid an allowance for going to school and in addition have your school paid for. If your friend wants to go for IU he first must qualify by getting that 40% rating up to 60% on his next C&P exam or present some more disabilities that give him a 70% overall rating with one disability being 40% ( which he already has ) Good Luck and God Bless.

I think it will be very hard to get TDIU for a knee problem. Just becaue your friend cannot stand longer than 10 minutes does not mean he cannot work.. There are many job that people in wheelchairs do, I suggest if he is so disabled that he cannot stand he should ask the va for a wheel chair. He should also consider vocational rehabilitation. Most will tell you that IU is not always the answer. In a case such as this it would make more sense to request vocational rehabilitation that to even think about TDIU. Vocational Rehabilitation was created for vets like him. Best of luck to him what ever he does...
